had an accident today

typical i took a day off of work to go to a hospital appointment. on the way home on my motorcycle there were 3 cars in front of me slowing down to stop at a pedestrian crossing there was 2 lanes of traffic coming against me and the cars did not leave room for me to filter on the outside but left plenty on the inside so i undertook to get to the front of them i passed the first one slowly i got alongside the second one and the idiot opened the door on me hitting my rear pannier and pushing me into a lamp post wrecking the bike luckily enough i am battered but nothing broken obvious in hindsight i should not have undertaken them but as they left me no room on the outside i thought t would be ok my question guys is although the undertaking is not good it is not illegal since the 1972 road traffic act as it was a pedestrian crossing with zig zags and she opened the door surly that is illegal in the first place and (the way i see it if i saw the door open i should have been able to stop) i was in sight of her and nearly in front (i didnt see the door open i just felt the shove sideways) as she hit the rear panniers is she at fault?

As far as I'm aware it is illegal to overtake where you have zig-zag lines on the approach to a pedestrian crossing. I may be wrong but I think it's illegal. I know parking on zig-zags is illegal but not sure about opening a door. What bike has she ruined? Glad you didn't come off too badly.

Not 100% sure but i thought zig zags were a no no for overtaking which technically speaking thats what you were doing. They are there for a purpose and pretty sure you were at fault. But the passenger should have looked first before opening the door so could be a 50/50 claim at best. Sorry for being the bearer, but at least no one was seriously hurt.

There's undertaking and undertaking. A motorway or even dual carriageway undertake when the OSLOC are out in force and you can legally travel within the speed limits in the inside lane...while the outside does 15 mph less, is perfectly legitimate and I'll do it all day long.

 

Up the inside of a car in an urban setting is risky at best, and on the ZigZags plain illegal, be it stationary or not.

Tough on you but I am afraid I cannot offer you any sympathy.

 

A few years ago, I was driving in London and had to stop at traffic lights, in the left hand lane and indicating to turn left.

 

As I turned left, there was an almost almighty bang - a cyclist had tried to undertake me - he was intending to go straight on and traffic going ahead was stationary. Fortunately, there were witnesses, including a taxi driver behind me who had seen my indicators and they stopped to back me up.

 

The cyclist was OK, the bicycle was a wreck, my car was OK and but I was mightily shaken up.

 

As others have said, it is just not worth doing something silly in an attempt to save a few seconds or gain a few yards.

no luckily enough the car door was just scraped because i was pushed into a lamppost my bike could be a write off and i am third party so thats me pretty much stiffed i can see what you are all saying about the undertaking i just didnt expect her to open the door

i ride my bike to work daily

if you were undertaking as slowly as you say then how was you bike written off??

my lad was knocked off last year he was goiny slow and only twisted his folks and got a scuff on the faring,

you must of been going some to have it written off

If you want to stay alive, do not undertake, especially on a bike :no: There aren't many scenarios where a driver expects vehicles coming up the inside. HGV's, in particular, have a blind spot.........they turn left, you come up the inside and get crushed. Be a little more patient, wait to pass on the right and your death won't be a burden on someone else for the rest of their life :yes:

Sorry to hear about your bike! But as a felow biker I can say I would NEVER drive up the inside of a vehicle :no: there is an OLD addage! Right side is pass side! Left side is suicide!

 

The fact it was a crossing is irrelevant. If you HAVE to pass on the inside at any point you should proceed with caution!
