I read this the other day,why make firearms laws to reassure the public and then totally ignore the guidance.

I bet if you or I were stopped with an air rifle 1ft lb over we would get the book thrown at us.

Some Judges are not connected to the real world.

Quote: Mum's anger at judge's comments that thief is 'young and impressionable'

Angry? I wouldn't be angry ........... I'd be apoplectic!! :mad::yes:

How about the victims 7 y.o. daughter? She is now suffering from nightmares because of this young moron.

The justice system in this country needs a major overhaul. Yet again, it's the poor young perpetrator who gets the sympathy from the courts, while the victim is left permanently traumatised by the whole incident.

I'd better stop now, I think ............... I can hear my ****** valve rattling! :whistling:

Recorder Michael Elsom said Phillips' age and the fact others told him to commit the crime meant the usual three years' jail for carrying a gun with intent should not be imposed.

He added Phillips may have acted 'under direction of others'

Well that's a contradiction. The "fact" and "may". If he co-operated fully with Police and named names could that have contributed to the leniency of the sentance? It's a sawn off shotgun so it wasn't "borrowed" from his fathers gun cabinet presumably.

I don't know, but could his age be a factor.

Edit: 3 years detention?

I believe so. According to CPS sentencing guidelines the starting point for a youth is 3 years, with a range of 1 - 6 years detention.

http://www.cps.gov.uk/legal/s_to_u/sentencing_manual/robbery/

Either way it is a pitiful sentence. The fact that he was 17 when he committed the offence is neither here nor there if you're confronted by the business end of a sawn off shotgun.

I doubt he'll change his ways.

Where did he get the gun from ? Is it unregistered? Did he have a certificate?

I suspect its an 'off record' firearm picked up illegally and the answer to the last question is, no.

In such circumstances thats 3 offences before you start with robbery with intent and using a firearm. I reckon 10 years about fits the bill. ******** slimeball, whatever his age.
