Police pulled me over

I was driving to my perm 5am Sunday morning to bag a few rabbits. As I was driving down the lane I noticed a police car waiting in a side road, I drove past they pulled out put the blues on I pulled over and they parked behind me. I waited for him to come over to me which he did and he asked me to step out of the car which I did.

I asked what I had done and he said there have been burglarys around the area and seeings it was an odd time for people to be out and about they thought they would check me out etc, which is fine.

He asked if I had anything on me or in the car that shouldn't be there, I replied no

He searched me and his colleague looked at the car.

I had .22lr bullets in my pocket which he asked "what's this" to which I replied bullets to my rifle which is in the boot of the car.

He was not very happy with this and asked to see some paperwork of me being able to hold such etc, thing is I didn't have it on me it was in my cabinet at home and my photo copied licence I accidentally put in the washer the night before, he was telling me that this is an arrest able offence me not carrying my licence with me and he should take my rifle bullets etc and I should collect from station with licence once I had gone and got it!!!

I didn't want this to happen so pleaded that I was very sorry etc his colleague had already radio my details across from my driving licence and everything come back ok and me being a sgc/fac holder etc, he let me go and I kept hold of my property his last words to me of the matter was to keep my paperwork in order and if he pulls me over again and I don't have my original docs I would lose my rifle etc and have to collect from station!!!

 

My question..... Does the police have the right to do this??

Yes they do. Sec 48 of the act provides that a constable may demand production of a certificate from any person they believe to be in possession is sec 1 firearms or ammunition or a shotgun.

 

If a person fails to produce a cert or refuses to allow a constable to read it the constable may seize any weapons and ammunition and demand the person gives their name and address. If you refuse to give your name and address you may be arrested without a warrant.

 

Though in force most cops do t know this or are happy with a check of the computer now.

They can sieze the guns untill you produce your FAC/SGC but considering it is all on the database they can just radio up and if you have ID it should not pose a problem.

 

I very much doubt it is an arrestable offence though.

 

Did you get any paperwork for the search or take the officers number? You can make a complain

they know who you where and that you had fac with in 30 seconds they got this info up befor the pull

They shouldn't have. speaking to someone that worked in the control room who said that they where only to give info that was requested and that the police needed a good reason for requesting info. so if they were stopping a car they could ask for the owners name address and if it is insured, mot'd etc not if the owner has a FAC

All firearms and shot gun licences are on the PNC police computer .what grounds did he search you on? and did he give you a record of the search because he should have done .

He didn't say what grounds he is gonna search me on, only said about burglarys around the area and wanted to search me and the car probably for stolen goods or tools to break into somewhere.

I didn't receive any paperwork from them.

The other policeman was already on the radio asking all details about me with the guns etc and all came back good but the other fella didn't wanna play ball really until I said sorry for not carrying it.

I would say it is good reason to be informed that a vehicle may contain firearms. Give the officers a heads up, They may wait for a more suitable place to stop you, and not be taken by surprise, and in worse case if your driving erratically, running from them etc it is vital info. However I don't think that they can tell your fac details from

Your reg, only your address. How do they know your driving etc. don't know 100% but I'm sure i was told they don't link it to registration.

i got pulled at 3 am after taken a mate home in my work van by under cover police car the officer said hello robert my last name said i see your insured with aviva and that you are a SGC holder and that i only had my mot done 3 days ago and this was all befor i even hello to him he then said sorry to spoil your night but where you been my reply was down the pub he said only have to stop you as someone been nicking central heating fuel around here was a nice guy the officer as my mate never had the seat belt on and he cold have keep us there longer to look on the van and breath test me as i said we was in the pub be he said to my mate you might need that seal belt on and then said on your way and enjoy your kebabs

Think the officer was bigging himself up,i shoot in some sensitive areas, and twice have had the armed anti-terrorism unit out,once in the middle of a field they checked the computer and all was ok,the second time in the dark in a gate entrance, while one chatted to me the other checked the vehicle and me out,told his mate exactly what i held,we then had a chat about my dedicated nv and their hand held stuff,i let them have a play and all good,an hour later the officer called my mobile and provided a phone number to use so they know i am out.

The bottom line is, if you go out with your guns, make sure you take your licence.

 

Better yet, buy a nice new PW wallet to keep it in, too. :good:

The bottom line is you do not need to take your licence with you,the officer would have looked a **** taking the weapons away after his partner had confirmed the op was legally entitled to hold them.

There have been loads of people on here being vocal about only carrying a copy of sgc/fac....

I carry the originals as then there is no argument....

You must have all your stuff too hand, as it is very easy to be put on the back foot with you stammering like a moped with a bad spark plug...

My FEO specifically told me you don't need to take your license - the police can radio it in and check. Saying that, it is probably a good idea to take it. If you think it may get wet or damaged, put it in a waterproof container like a zip lock bag or something.

You sir are right but they have the power to take your guns away without it , like it or not that is the law :yes:

the very thought of my gun being chucked in the back of a squad car means i carry mine every time i go out :good:

It is strange but all the people on here who have been stopped none seem to have their rifles removed and all seem to be checked by a simple call,as i said.

Been stopped a few times (hazard of being out and about at stupid o'clock) even had the local neighborhood annoyance machine (helicopter) not once repeat once was I asked to show my ticket, my reg and name was more than enough for them , they even had my mobile number.

been stopped for shooting at airplanes by the police 2 years ago,some concerned citizen seen a cammo wearing terrorist trying to bring planes down with his assault rifle,<my hatstand escort pigeon shooting>>.cops were calling for me by name as theyd pnc checked the car already.left the hide fask mask off gun unloaded .cops phone goes concerned pillock screeming ave u got im on loudspeaker ,police trys to calm eejit down whilst 2nd copper and me in stiches laughing our heads off.sgc viewed happy campers .cops ave a look at said assault rifle n agree said concerned citizen watching too many films whilst reading the daily mail.

I'm just thinking about this, who would be responsible if anything happened to your rifle if you did have it taken from you, for example. The officers fancy a Krispy Kreme or a coffee, pull up outside a shop, service station, garage, whatever, and they come back to the vehicle and it's gone ( gotta be a gutsy thief but it has happened in the past I presume ) or another one is they get to the station and the officer drops it and dents the barrel or breaks it as it lands on the floor, you turn up later on with your license and take a look and it's KO'd or not even there, what would happen then?? Just a thought :)
