Almost certainly cps as they give the charging advice, but as it's the police that pass the message on it's naturally their fault. Is that correct?do the CPS give charging advice? I understood it is they who decide whether to prosecute or not!.....in any case whoever made the decision obviously didn't bother trying too hard to bring this cowardly thug to justice! It is up to them if there is enough evidence to make a prosecution likely and whether its 'in the public interest'. So they can and often do throw out cases the police bring to them.
