There are various exemptions which are prescribed by the Hunting Act, they are as follows: Up to two dogs may be used to stalk or flush a wild mammal from cover for defined purposes One dog at a time only, may be used below ground to stalk or flush a wild mammal for the sole purpose of preventing or reducing serious damage to game birds or wild birds being kept or preserved for shooting Defined Purposes What is meant by defined purposes? Defined purposes include the following: The protection of game birds, wild birds, fisheries, crops and livestock Obtaining meat Field trials To qualify as exempt the above activities must always be done with permission and reasonable steps must be taken for the purposes of ensuring that as soon as possible after being found the wild mammal is shot dead by a competent person and that the dog is brought under sufficient control that it does not prevent the achievement of the objective. pork chop Posted June 25, 2015 Author Report Share Posted June 25, 2015 Not worried at all,just not for me.reason i asked is that me and a mate were called out to thin the vermin including fox on one of my mates farms and got into an argument with some else who goes on the same place who seems to think all the foxes are his as he digs them out using terriers.hares are also a problem on this farm and the farmer has asked for theses to be thined out also,and guess who thinks they also belong to him.was just going to arange a little visit for him thats all as i didnt think it could done anymore Quote Link to comment Share on other sites More sharing options...

pork chop Posted June 25, 2015 Author Report Share Posted June 25, 2015 I think you need to be having a word with the landowner to sort the job outthis chap happens to be the landowners uncle,hes doing his nut over it his wife more so but for some reason no one wants to upset himdrives me and my mate mad.mate went up there the other evening after being called out again and was assured there wouldnt be a problem as the uncle was out of the country had a few shots and before long a 4x4 was heading his way seem the uncle has a sidekick keeping watch when hes away. If he is doing so for any other reason he's breaking the law. From the act.......... Use of dogs below ground to protect birds for shooting2(1)The use of a dog below ground in the course of stalking or flushing out is in accordance with this paragraph if the conditions in this paragraph are satisfied. (2)The first condition is that the stalking or flushing out is undertaken for the purpose of preventing or reducing serious damage to game birds or wild birds (within the meaning of section 27 of the Wildlife and Countryside Act 1981 (c. 69)) which a person is keeping or preserving for the purpose of their being shot. (3)The second condition is that the person doing the stalking or flushing out— (a)has with him written evidence— (i)that the land on which the stalking or flushing out takes place belongs to him, or (ii)that he has been given permission to use that land for the purpose by the occupier or, in the case of unoccupied land, by a person to whom it belongs, and (b)makes the evidence immediately available for inspection by a constable who asks to see it.
