New private parking fine rules ??

I have just read that apparently a new ruling at the high court says that the private parking leeches sending those fines is now enforceable :/

 

Anyone have any news on this ?

 

Literally only got one today, the sign saying about it was actually totally blank so I feel o could contest it, although I was just going to ignore the swine as I've done so in the past.

Argument was lost over hiw proportional fine was, not other reasons.

 

If signage is inadequate or missing, that is still a valid defence.

 

If it goes to court a picture of said signage will invaludate companies claim. Ignore it but get pic of signage as evudence.

 

Think it's pretty clear ?

I ignored one from a McDonald's car park from met parking for £50 which ended up being passed to a dept recovery firm and increased to £150! Ended up contacting McDonald's customer services told them I would never use their restaurants again and they reduced back to original £50. Learnt after if I had gone to the McDonald's restaurant in the 1st place they would have instructed met parking to remove the charge. Lesson learnt!

Re above you need to appeal sending photo of blank sign and guess it will be waived.

As a landowner, with people parking on his land, him being unable to access his garage, my best pal finally put up signs. That didn't work so he introduced a £25 fine.

 

It took a while for people to notice so he can now get to his garage but he still gets one now and again.

I was parked at the side of a road, on a business park, where the company I work for has offices. It was not sign posted (as you can see) ànd i was not blocking any cars or entrances in anyway.

 

 

 

As for your mate, unfortunately putting up a sign isn't justifiable to start giving out "fines".

I agree with your post Lloyd, the sign is clearly blank and some companies will try anything to make a fast buck.

 

He left it a few days before the fines started. It almost came to clamping but people got the message. He was at desperation stage.

To make a fine endorcable it has to carry the power of law, I.e been placed there by the council or police with the permission of a court.

Private companies do not have the power of the court behind them so they issue you with an "invoice" which they try to convince you you have a duty to pay. If I opened a company ad randomly sent you an invoice you would not pay it as we would have no legal contract between us saying you must pay or where you have agreed to honour it (and quite rightly so). It's the same with private parking fines, as you have never signed any contract with that company and they do not carry the weight of law behind them it is unenforcable

The same rules apply to any council operated mobile speed camera vans that pop up now and again emblazoned with "working in partnership with Herts constabulary" , only a police officer or fixed camera (which has its own legislation) can send out legally endorcable speeding tickets, not Derek from the council offices (otherwise we could all go and sit at the side of the road dishing out fines whenever we wanted) however If when asked the local council can supply the badge number of the police officer who was present at the time the ticket was issued and witnessed the offence it becomes endorcable (but they can't and usually try to squirm out of it using some data protection act garbage)

I don't understand why people think they have a right, to free use of other people's property. Furthermore, I don't see why a property owner, shouldn't be allowed to make a reasonable charge for any inconvenience caused. If there is no sanction available, then people will take advantage, and without thought, divest the property owner of his rights.

 

That said, there does need to be clear signage: those property owners that deliberately set out to deceive and take advantage of the unwary, are fraudsters, in my view.

It was a knee jerk reaction to greedy land owners clamping vehicles. They would leave access to land wide open, hide signs behind bushes or other signs then call in clamping firms and enforce a ludicrous release fee.

 

The quick and simple way round it was to ban clamping. Of course this doesn't affect councils or government, they're still allowed to clamp / remove vehicles :rolleyes:
