Secondhand faulty gearbox problems

I have had a garage source and fit a hand gear box in the wife's car only to find the replacement box faulty!

The garage has offered to replace the box with another from the same supplier for free but, and this is the real issue, the garage won't give a guarantee for the replacement unit and fitting!

What the garage has suggested is that we source a new reconditioned box from a local gearbox specialist and take it back to the garage for free refitting, but again no guarantee from the garage. Now if this new box comes from the gearbox specialist with a guarantee and it proves also to be faulty would they, the gearbox suppliers, also be liable for refitting of a replacement unit?

Many thanks in advance

i have a garage and this the situation if the garage supplies a part wether used or new and fits it the garage according to trading standards has to garantee for a year parts and labour or a full refund.which totaly amazed me. the situation arised with me when i ran a 24 hr recovery business and we picked up an old rover 214 with a snapped drive shaft bloke was a total dole wlaller coudnt afford anew drive shaft and asked to get a second hand one from the local breakers yard which we did £10 quid for shaft and £25 to fit it snapped again 7 months later and green flag called us for recovery and we dragged it yes same drive shaft snapped but second hand no warranty.off he goes with huff and next call trading standards you either repair car at no cost to customer and garantee till 12 months from original date of repair or give him full refund bloke wasnt negotiable so gave him £45 quid and f----- him off big style car was not worth much more big argument with owner and green flag agreed to take him home in town which we did to drop him outside his house only he wanted us to push his car into his drive which we refused for his manner and owner did on his own local bakery manager called to collect his car and got talking and noticed i was annoyed and i told him story and the car owner worked for him and was on sick with a work related injury and was supposed to be wheel chair mobile and crutch assisted and tribunal next week could i make as statement to say he pushed his car into his drive without his wheel chair and crutches.i love it when things turn round for the sake of 45 quid he lost his tribunal and his job.

The problem is with so many parts on cars today if you are getting second hand parts you really need to take the part off and get any numbers that may be stamped on it as car makers do like to change things when I had my jeep I get several new parts going by the book year etc only to find that they had changed something so that it would not fit so if you cannot fit the parts yourself leaving it to the garage to get the part is not a bad idea.
