Bit of a two parter here so bear with me.

 

I Made a balls up the other day and thawed out a freezer. Fortunately it only had a few old bags of chops in it so it wasn't the end of the world.

 

We have an 11 acre hay field that backs up to an old quarry on one side and a sett in the far corner. The hay has come off and I wanted to have a look what was about so an idea came to me.

 

I set my camera out on a badger run 150 yds from the nearest foot path over looking some rough grass the mower missed and chucked out a few defrosted chops.

 

Well **** the bed I was up there today looking at my photos and up pops local *****/busy body and all round interfering knob to see what the meat was. Apparently he was worried someone had been trying to poison the Badgers. With pork chops! In front of a camera trap! 10 minutes passes talking away with pillock number 1 explaining that I've got various images of him stood obliviously in front of the camera debating what the meat was. And pillock two appears. This ones a twitcher as well as a ****. He was concerned someone had been trying to poison the Ravens or red kites. Both have moved from the town to the country and are mad keen on preserving all the wild life. After probably nearly 45 minutes talking to these morons finally went on their merry way.

 

What really ****ed me off apart from pillock one ringing the badger protection people worried about poor old billy was the fact they're walking the boundary of our field and not sticking to the footpath!

If I could afford it I'd build a massive high fence the full length of the footpath!

 

It was so stupid like if I was trying to do something dodgy i wouldn't be trying to take videos and photos of it and I wouldn't leave a pile of very obvious meat in front of the camera which I put out from the boot of my very obvious truck with personalised number plate!

Trespass isn't an offence

That all depends. the Criminal Justice and Public Order Act 1994 created some circumstances in which trespass to land can be a crime.

Trespass is a civil wrong - a tort - like when someone drives into the back of your car - and you have to bring a civil action about it. "Trespassers will be prosecuted" is a bit misleading because you have to "prosecute" it by bringing a claim for damages or an injunction in the civil (i.e. county or high) courts. The police aren't interested because it is not a criminal matter.

 

Now, aggravated trespass is something else and if they're trespassing to disrupt a lawful activity or to cause criminal damage that is within the criminal realms.

You would be better with a 'High Fence' than than trying to prove an 'Offence'. I once had dealings with the RSPB whose Agent had installed a camera, in a wood, overlooking a Gamekeepers Larsen trap. They had entered the wood as Tresspassers and installed the camera. They had been informed that the trap was set to catch Sparrowhawks. The camera had mysteriously vanished and they wanted a Prosecution, quite of whom and for what, was never established ? It ended with me telling them that the Keeper had now left the area and was 'doing weddings' with his new camera !! :whistling:

We get loads of " Right to Roam " people just walking dogs where they like. One came to look at my decoys in my line of fire to see what the were??. I used to put out laminated notices " Pest Controle in Progress Please Keep to Footpaths" they still walk all over.

Ive had people walk past me when in a highseat before. Not even seen me, then on the way back ive shouted down asking how their walk was and that the footpath is three fields away. People walk where the want, not much can be done to stop it.

I find folk wandering the estate hundreds of yards off the footpath, they usually come out with the usual that they thought it was a path. One bloke last year with a pointer dog off lead seemed quite pleased with himself when I challenged him, he asked why he needed to be on a path, I said because we have game birds down his reply was that his dog had only killed one bird and that was over a week a go 😞 found him in same spot a week later (this is whilst dogging in by the way) were now a week away from game season. I told him the next time I see him off a path or with his dog off a lead I will ring the keeper who is currently highly stressed due to pending game season and not in a very good mood of late.

Didn't see the bloke again.

Last sat keeper and I chatting edge of field me with gun under arm, bloke appears with two dogs middle of a field no were near the footpath, unbelievable 😞

Had this sort of thing many times, and invariably Joe Public thinks that they can wander where they want to.

 

They always look puzzled when I point out that they are not on the footpath, and in fact trespassing on private land.

 

If they want to argue the point I now politely ask them where do they live, and I will come and wander all over their private front garden......

I had a camera set near my barn, mainly for security . However one morning when I checked it I had caught a most unusual sight. This lady had decided she could not wait to get home to spend a penny and presented a lovely full moon shot to the camera. The funny thing was her partner was trying to shield her modesty but failed to see the camera pointing down on her. I did think of printing it off and putting the pic on the gate saying do you know this tresspiser.
