Brake pad warning indicator 2001 VW - MOT Fail?

I have a 2001 VW Passat for shooting and towing. 
 

recently the pad warning light and message came up on the dash. 
I only had them done 12 months ago with decent spec pads but thought maybe a sensor had gone or they were worn down. 
 

changed today for decent brembo pads and it’s still illuminated. 
obviously I know the pads are new so in good condition but it’s due an MOT in the next few months. 
 

is this item now a fail ?

Yes it is a fail. Perhaps an easy fix. I had this problem and it was a broken wire to th pads.

I have just had the pads replaced today - they have a built in sensor wire that drops to a connector block. This then disappears up into the struts and metalwork

No fault codes. 
 

i’m beginning to think the wiring has gone somewhere from the loom to the final car connector. 
 

I think you can reprogram the ECU using VW software to remove the warning. 
 

if it is a fail item I may well have to explore that option or bridge the wires further up

I've got the software to turn it off, if your anywhere near Portsmouth I'd be happy to do it for you.

The failure is "brake pad worn down to the wear indicator".

If the  pads are clearly not worn to the wear indicator, and the tester can see that, then it's a pass even with the light on.

Thanks for the clarification. 
I did read the testers manual and I also read it that way but one company I spoke to said they would fail it ( a VAG specialist) and quote for fault finding on it. 
 

hooked up to a diagnostic machine and it was a duff wire in the car connector side creating an open circuit.
