SGC revoked under section 30c

I was granted my first ever SGC in Feb this year, I disclosed all convictions on the application namely driving without insurance and a fraud conviction for which I completed community service.

I've since also joined my local shooting/rifle club, Ive completed the probation period and applied for my FAC 2 weeks ago. All going well.

Out of nowhere armed police turn up to my door last night, they were polite enough, informed me that my SGC had been revoked under section 30c of the firearms act 1968 and they seized my shotguns which I duly handed over.

I have not been arrested or been involved in any criminal activity during this time and my medical records are also clear.

I am a BASC member and will be contacting them for advice in due course.

Do any members here have any experience or knowledge about this kind of issue and what may be done, Thanks

Shotgun (revocation)

Section 30C(1) of the 1968 Act:

A shotgun certificate may be revoked by the chief officer of police for the area in which the holder resides if he is satisfied that the holder is prohibited by this Act from possessing a shotgun or cannot be permitted to possess a shotgun without danger to the public safety or to the peace.

Prohibited persons under the Firearms Act

Section 21 of the 1968 Act (extract):

(1) A person who has been sentenced to custody for life or to preventive detention, or to imprisonment or to corrective training for a term of three years or more or to youth custody or detention in a young offender institution for such a term, or who has been sentenced to be detained for such a term in a young offenders institution in Scotland, shall not at any time have a firearm or ammunition in his possession.

(2) A person who has been sentenced to imprisonment for a term of three months or more but less than three years or to youth custody or detention in a young offender institution for such a term, or who has been sentenced to be detained for such a term in a detention centre or in a young offenders institution in Scotland or who has been subject to a secure training order or a detention and training order, shall not at any time before the expiration of the period of five years from the date of his release have a firearm or ammunition in his possession.

(2A) For the purposes of subsection (2) above, “the date of his release” means-

(a) in the case of a person sentenced to imprisonment with an order under section 47(1) of the Criminal Law Act 1977 (prison sentence partly served and partly suspended), the date on which he completes service of so much of the sentence as was by that order required to be served in prison;

(b) in the case of a person who has been subject to a secure training order–

(i) the date on which he is released from detention under the order;

(ii) the date on which he is released from detention ordered under section 4 of the Criminal Justice and Public Order Act 1994; or

(iii) the date halfway through the total period specified by the court in making the order, whichever is the later;

(c) in the case of a person who has been subject to a detention and training order—

(i) the date on which he is released from detention under the order;

(ii) the date on which he is released from detention ordered under section 104 of the Powers of Criminal Courts (Sentencing) Act 2000; or

(iii) the date of the half-way point of the term of the order, whichever is the later; (2B has been repealed)

OK, did you put something on your FAC application that you didnt mention on the one for SGC ?

Are your referees squeaky clean ? It wouldnt be the first time someone used a supposedly 'clean' referee, who was actually known or suspected by the police of being involved with crime.
This puts you in association with a possible criminal element.

Have there been any domestic incidents in your past ?
Most forces are conducting reviews into grants and renewals where they are re questioning suitability.

Usually the police turn up with a revocation letter that sometimes explains why. If not , get BASC to call them and ask them.
The police can be VERY reluctant to discuss this with BASC, you , or even solicitors*

What force area is it ?

Ive been through this myself, mine was more medical, and was quickly cleared up, but its a very unpleasant situation.

*One of my club members is fighting a refusal of FAC grant at the moment, due to his criminal record, he swears blind he has no convictions , arrests, cautions , or any other reason he could think of.
He is a security system specialist who has fitted alarms in police stations , and is fully CRB checked.
He even had his home visit and was told his ticket was in the post, then got a letter saying it was cancelled, they havent even refunded him.

He is into £1500 worth of solicitors fees at the moment, and the police are barely talking to the solicitor after 4 months, appalling situation.

B......H... you hear about this stuff in passing but when you hear of the reality it sounds like the police are getting completely out of hand.

no retrieved mine twice last one was wishy did anyone apologise after his ticket was returned because he was telling us the truth?

A good mate has been through hell - when he called me to tell me he had split up with his wife I told him to get his guns stored/transferred - he didn't. He has had them back twice and removed twice - he now has had his ticket back for a while without incident.

It only takes a phonecall from the ex to really mess you up....
