al4x Posted January 27, 2009 Report Share Posted January 27, 2009 well according to Mr BASC they don't include a get out clause with regard to having two sets of Insurance so I'd guess they would volunteer to pay. In practice I wouldn't be surprised if they both tried to pay half but to me its a bit of a minefield and you may just be able to put the claim into the one without mentioning that you have cover with the other, especially as in theory your house insurance may cover you as well Quote Link to comment Share on other sites More sharing options...
David BASC Posted January 27, 2009 Report Share Posted January 27, 2009 Under UK law you cannot claim twice for public liability – so if you have two policies you cannot make a claim on both. Nor can you make a claim yourself, get paid out and then make the same claim via your insurance policy. It is not uncommon for people to be insured more than once. When a claim is made on the BASC policy our insurance team and their lawyers will take up the case and deal with it. We will ask if there are other insurance companies involved, (membership of other organisations for example) and if there are our insurers will contact them as needs be to see if they too have an interest in the claim. It is very common for this clause, to seek out other insurance policies, to be in an insurance contract. The big difference is how this clause is used. Some policies for example are written so that if a claim is made on policy A, and it is found that another policy is in play, then policy A will not respond and will pass the claim to the other policy. This is NOT how BASC insurance operates. Importantly, the discussions between insurance companies will take place ‘behind closed doors’ as it were so the member and the person making a claim do not have to get involved in discussing / negotiations with different sets of insurers and lawyers – which makes sense I think! How the CA or others will deal with a claim in the same instance I do not know, and it would not be fair for me to take an educated guess, maybe a call to them is needed to get the answer.
