My moderator exploded!

I would insist on them sorting it....... Whatever that means for them. As long as you get a checked mod back you should be happy. Isn't that what the 2 year guarantee is supposed to be?

 

I have the same mod and all is good, but like chokes on a Shottie, worth a check each outing....... The stability of the mod changes with temperature. There isn't much thread if it loosens p a bit.

I don't know how I can do that? They've put forward their argument and as the missing baffle is the evidence I need I'm out of ideas. I suppose I could metal detector the site for fragments but that would cost me more time than a mod would cost me money.

 

If they don't help me they'll be put on the same shelf as The Sportsman - I'll simply slate them with an honest story every time the chance arises and never spend my money there again - the amount I change stuff that will cost them more than they are looking to lose on a replacement mod with my spending alone.

 

Edit... I'd accept that as a possibility but I'd checked it the shot before because it was on a new rifle. It was correctly assembled and not loose. I'm 100% certain of that.

Try and contact your local metal detecting club I am sure someone will come and look for it for the price of getting to the site, plus a pint or two.

I would come myself but it`s a four or five hour drive. LOL

Can I suggest that you write a carefully worded letter to Jacksons, it must be in writing. Outline your case and the fact that it is still under warranty. Even if it means repeating the information you gave over the telephone get it down in writing. Clear and polite.

Having given the facts as you see them, suggest how you would like the matter resolved. Free replacement parts, discount on a new moderator, whatever. If it was me I would not want the old one repaired as I would no longer trust it, particularly if you can feel a bulge. Obviously don't even hint in your letter that anything could be your fault. Never put into writing something that you would not wish to have read out in court! Including forum posts!

See what Jacksons considered response is. It may be different now they have had time to give it some thought.

If you are happy that you are completely in the right, and as you said in your first post, have witnesses. Take your claim to the small claims court. It is not as scary as it sounds. If you lose you will only lose the court fee (maybe £50) and would only very rarely have to pay the other sides costs. The mere threat of taking the case to court would possible encourage a satisfactory settlement.

I spend a lot of money on shooting kit and have had six moderators that I can remember off hand that would have been sourced from Jacksons in as many years. If they want to play the game they've lost me as a customer. So it will cost me a couple of hundred quid - it will cost them a lot more over time.

 

I would obviously have to tell anyone who asks a question about CMM4 mods my story too. Not making anything up, just the simple facts and truth. If a modular moderator is assumed to be incorrectly assembled due to it's design then it may as well not have a warranty. I can of course see their side of it too, but that's not my problem. They choose to sell the product - I simply bought it and expect fair treatment.

Phone trading standards, get their free advice and act on it. There is no need for the small claims court and I fully agree it aint worth the stress, time and hassle the process takes. Even less so if the defendant gets the case transferred to the Scottish system.

So if I have read this right this mod was brand new,if so under the sale of goods act they the company have to prove the item wasn't faulty for the first six months of you owning it,after that first six months you would have to prove the mod was faulty. Usually by independent specialist. So my advise would be if it's the first six months ask for there reporting writing

I was indeed. But there's nothing for a bloke to do pre wedding. Just having a moan on here before I had to get all smart and head to the venue. Mrs said I wasn't allowed to change the oil in my tractor and get my hands dirty so it was down to good old PW to pass the time! :lol:

 

The mod is over six months old. I'd been using it on my .223 for about a year but it was still in warranty. It was when it went on the bigger gun that the problems started, but it was a 6.5 mod so .243 was well inside design spec. I'll not be taking the matter any further if Jacksons refuse to help - I can go out and earn what the mod costs in the time I'll spend fussing over it and I'd prefer to see how they treat me without forcing the issue. that's what I'll base my future opinions on when I'm chatting to folk at the range or on forums.
