Just watched this interesting debate about tail docking.Apparantly it is soon to be illeagal in the UK from April (already banned in Scotland)to dock the tails of dogs but, I think I heard right that working dogs will be exempt. I personaly think some dogs look weird with tails, but I suppose you just get used to seeing certain breeds without tails

The Animal Welfare Act 2006 comes into force in England on 6th April 2007.

"An outright ban on tail docking of dogs in England and Wales was rejected by just 11 votes. The exemptions backed include dogs used by police forces, rescue services, the military, pest control firms and in sport shooting. "

(3) Subsections (1) and (2) do not apply if the dog is a certified working dog that

is not more than 5 days old.

(4) For the purposes of subsection (3), a dog is a certified working dog if a

veterinary surgeon has certified, in accordance with regulations made by the

appropriate national authority, that the first and second conditions mentioned

below are met.

(5) The first condition referred to in subsection (4) is that there has been produced

to the veterinary surgeon such evidence as the appropriate national authority

may by regulations require for the purpose of showing that the dog is likely to

be used for work in connection with—

(a) law enforcement,

(B) activities of Her Majesty’s armed forces,

© emergency rescue,

(d) lawful pest control, or

(e) the lawful shooting of animals.

(6) The second condition referred to in subsection (4) is that the dog is of a type

specified for the purposes of this subsection by regulations made by the

appropriate national authority.

(7) It is a defence for a person accused of an offence under subsection (1) or (2) to

show that he reasonably believed that the dog was one in relation to which

subsection (3) applies.

(8) A person commits an offence if—

(a) he owns a subsection (3) dog, and

(B) fails to take reasonable steps to secure that, before the dog is 3 months

Anyone know which dogs are "of a type specified for the purposes of this subsection by regulations made by the appropriate national authority."? I know in the Welsh consultation paper HPR breeds were not included!

And what is accepted as "evidence as the appropriate national authority may by regulations require for the purpose of showing that the dog is likely to be used for work "?

Also, any dog docked after April under the exemptions will not be allowed to be shown at any event that charges the public an entry fee (crufts etc). This ruling basically scuppers the 'duel champion' status of ShCh an FtCh.

PS... Crufts is on BBC interactive now.

No probs. The raw recording is just over 2gig in DVR-MS (mpeg stream in 16:9 freeview), which will play in media player fine. I can stick it on DVDs and send to peeps if they want that (for watching on TV). I will also encode it to a smaller WMV file and upload it.

Does this also mean that you will not be able to run a dog in a scurry or working test at a game fair?

The law itself is absurd and the problem is the case for tail docking is not being put forward correctly. Caroline Kisko may well have talking against it for all the good it did. The argument for docking a dog because it makes the breed look right holds about as much water as a bucket with no bottom.

No one is coming out to say how dogs will be badly injured in the working field if they are not docked. BASC have done their bit but the KC only seems interested in show dogs.

The mumbo jumbo from the act states...

(9) A person commits an offence if—

(a) he shows a dog at an event to which members of the public are

admitted on payment of a fee,

(b) the dog’s tail has been wholly or partly removed (in England and Wales

or elsewhere), and

© removal took place on or after the commencement day.

(10) Where a dog is shown only for the purpose of demonstrating its working

ability, subsection (9) does not apply if the dog is a subsection (3) dog.

(11) It is a defence for a person accused of an offence under subsection (9) to show

that he reasonably believed—

(a) that the event was not one to which members of the public were

admitted on payment of an entrance fee,

(b) that the removal took place before the commencement day, or

© that the dog was one in relation to which subsection (10) applies.

So it looks like it's only "show" dogs that are affected.

Sorry about the lack of video posting on this thread, but I'm having a distinct "issue" converting the 2gig DVR-MS file to anything else atm. I'll keep on trying....:lol:

If anyone wants it on DVD (it plays in windows media player and VLC) just shout with address in PM and I'll dispatch the whole high quality thing.

Thanks John, it looks like it might. You won't beleive how many dvr-ms converters I've tried in the last week.... I'll set it going now and see what happens. Looks like it converts to MPG which should then allow encoding to xvid/divx avi and hence be nice and small :D Fingers X'd.

  • 2 weeks later...

As an old school friend of Simonp, as he knows, I have very strong views on the docking of working dogs tails.

I was one of a few who went to London last year to lobby parliment on the exemption for working dogs.

However, government are now trying to "worm" their way out of our exemption.

I am now stuck between a rock and a hard place, I will be putting my Springer bitch in pup ( not personally Si!) this spring and am already looking for a vet who will dock.
