Only if the current MOT has expired, otherwise the system would show a current valid certificate even if it had failed a test before expiry. Assuming the police take their information from the same DVSA database we use, you could see the failure if you wanted to look, but if there are no other issues it wouldn't flag up. Plenty of cars we test have expired MOTs, sometimes by months. I think it's mostly due to not realising. I think Plod have other more pressing issues to worry about.
