The 2nd one you refer to is in reference to taping of disciplinary meetings in various forms and again is not pertinent to the uninformed taping of an individual. The first case requires the use of current legislation and is strictly controlled. The 2nd case was deemed 'admissable' as it did not infringe the privacy rights of an 'individual', whereas secretly taping the lecturer without her knowledge, regardless of the purpose, most definately is. In the 2nd case this was only deemed admissable at a Tribunal and does not affect or alter 'Case Law' as I understand it. The rules used in Tribunals are far more relaxed than in a court of law and any decisions made are done so on 'the balance of probabilities', where no definitive burdon of proof required. All very complicated I agree and an absolute minefield for the inexperienced of which I am one, but I have had cause to resort to this legislation in all it's complexities. The general rule of thumb for the layman is that if you are going to record someone and present that recording in some form of evidence at some future date, you must have the permission of all parties involved if you don't want to fall fouls of current legislation. As an aside I'm glad you seem to have the matter sorted Flash. The direct approach is usually the best in the first instance and has the side effect of clearing the air. She would also appreciate that you had the nouce to go to her first rather than go over her head and let it build up, possibly out of all proportion.
