al4x
Its interesting but without knowing the history hard to be too judgemental, balloon companies do run close to the wire with regard to damaging crops and livestock and you do have to proove a claim which can be hard, facts is they do scare the hell out of livestock and horses and in this case chickens. What we don't know is whether there was history of problems with balloons on the farm, there can be as certainly round us they take off in the same place and with the prevaling wind often go in the same direction. I shoot on a farm where the landowner had endless problems with trail bikes, no help from the police at all at that time and all he got was lip from the bikers and carried on riding over crops. One day while pigeon shooting he sort of flipped and shot one of their helmets on the ground well away from them. Police weren't slow to react and guns away locked up for the evening, went as far as crown court where it got thrown out he is the quietest mildest bloke I know just made a hasty rash decision and hasn't shot since, when your livelihood is at stake its surprising how you can be pushed to the limit. In this case if they hadn't been trespassing it wouldn't have happened
Pigeon_snIPer
I think the judgment was too harsh, all said and done it is her land and the baffoon sorry balloon was encroaching on her property without proper authorization. She should have been given a warning and a course in anger management at the max. /S/
docholiday
As the owner of the land could you refuse entry of the 4x4 claim the ballon and offer it back once fair compensation for crop damage was agreed. after all the ballonists are making profit out of using other peoples land no idea on the law though doc
al4x
I think you can but it is slightly dodgy ground, you can refuse the 4x4 access and make them carry it out though which is the approach I'd take. What they do though is try and get in and out without being noticed, its fine the occasional one but we have companies over our way flying a couple of balloons morning and evening all summer from the same location so they have a fair chance at landing on the same farm pretty regularly
