Once again if like to ask the pw massive for guidance.

Quite a while ago now I was rear ended by a 29 yr old. I was stationary, two witnesses. His parents still told him to say I was reversing. Once witness statements were in, they admitted liability.

When they tried saying it was my fault though, I had to begin a claim. It was right at renewal time, so my renewal went up with an open claim.

I never agreed for any work to be done in my car, they sent someone round to look at my car and estimate cost. But I was still waiting for them to admit liability. Now they have, I wanted to claim through his insurance to keep my insurance claim free. My insurance is now saying that their garage went ahead and ordered £840 worth of parts for my car, and I will have to pay for them if I don't get my car fixed there!!!! Is that right?

Also is there any difference if I cancel my claim and go through his insurance or if I carry on through mine?

Car insurance makes me so angry! Where's that spare door!?

If you didn't give any authorisation for repairs to go ahead, and if you told them that you wanted to wait until the issue of liability had been sorted out, then I'd tell them to do one. Say you want the parts, etc that have been ordered listed, itemised, and an invoice provided, and also inform them that you want the part of the terms and conditions of your policy that allows them to do this to be pointed out to you in full.

You have the contract with your insurer and it is legally binding so if they progressed the claim without your consent they are in the wrong. However be very careful as all calls are, or should be recorded, and in the course of a long phone conversation you may have intimated you were making or notifying a claim. Went through this myself recently (and this was my old job) when an idiot ran into the rear of car on car park. I notified the incident but really had to get quite heavy with the young lass taking the call when she kept referring to my "claim" - NO I'm notifying, in accordance with policy conditions an incident, I'M NOT MAKING A CLAIM are you stupid or something girl???? The next thing was a note to say TP had made a claim - again I had to ask how could they let a TP claim on my policy as this was my contract with you, you stupid insurance representative. Then I got a letter from my insurers saying my NCD was not prejudiced as TP had withdrawn claim. Another phone call to stupid insurance person - "interesting as I've never made a claim on my policy" - tell me stupid insurance representative will the TP be paying my premiums next year as you seem to be taking instructions from him not me??

If they've admitted liability then your insurer will recover their costs from the third party. So they will pay for the repairs and then claim it back. Should be classed as non-fault and won't affect your NCD. Some insurance companies do charge more if you've had a non-fault claim though... Luck of the draw. I'd definitely ask if, now the 3rd party has admitted liability, you're due a reduction in your premium due to overpaying at renewal now the claims classed as non-fault.
