clayman Posted December 31, 2011 Report Share Posted December 31, 2011 So far: We have successfully defended a claim against a CCC3 member. Member shooting fox hit a walker's dog. The walker was also armed and dispatched his dog at the site, but claimed £5000 for the dog. Our legal defence took charge and it was established the walker was trespassing - the average value of that breed was £500, and that as the option to our insured to get vet attention was not given, the death of the dog was the action of the walker. Claim deflected. An insured syndicate member interpreted thieves poaching pheasant stock and was rammed by them in a car. This claim was outside the policy scope and not pursued by the victim. They were actually engaged in an agricultural activity ( bird rearing) - this in itself is not hunting / shooting, and we advised them to pursue the thieves for damages in the court. Plenty of no-win-no-fee lawyers who will take up compensation injury claims of this nature. CCC3 legal cover is to defend our member against a claim by a third party ( as above) - not a system for a CCC3 member to pursue damages against third parties. We have a current claim, a member was injured while at a shoot and was hospitalised. While none of the injuries was severe enough to make the personal accident payouts apply, ( cuts, bruises, broken bones are not enough - P/A payouts are for eye / limb loss and permanent disablement / death), as the member was hospitalised he may be entitled to the Hospital Benefit. This claim is pending further information from the claimant, ie evidence of hospitalisation period. Thats it so far in three years, and 3600 members insured.
