We have a fox problem

Hi,

 

Last year we were plauged by a fox from April until August when it was shot. (well a 3/4 cub was and the string of 20 chicken and duck deaths stopped) Anyway on Saturday a tame pet chicken was stolen off my Gran's lawn on Saturday and a cockerel today. :blink: As Dad said it will be every other day...

 

Now, Easter holidays are coming up and I could quite happily wait all day for as long as it takes and nail it with BB's however it's probably in cub. :good: Now some of you will say get on with it you soft sod and to be honest I probably will but I was wondering is it legal to use a terrier to deal with orphaned cubs like Frank does in Ireland within the law of our silly hunting act? I doubt it though. :) Also what is the law with regards to collared terriers underground with when your protecting my pheasants and do our pheasants have to be caged for this to apply?

 

Anyone have any ideas please? :)

In view of the news today about a guy being fined £750 (plus £5,000 costs) for foxing with dogs then I would suggest that you have to be 100% within the law if you want to use a dog against foxes.

 

The above person also had the stupidity to go foxing in the region of a badger sett.....

 

I personally don't know the law now about using terriers 'legally' - can someone please explain.

Use of dogs below ground to protect birds for shooting

 

2 (1) The use of a dog below ground in the course of stalking or flushing out is in accordance with this paragraph if the conditions in this paragraph are satisfied.

 

(2) The first condition is that the stalking or flushing out is undertaken for the purpose of preventing or reducing serious damage to game birds or wild birds (within the meaning of section 27 of the Wildlife and Countryside Act 1981 (c. 69)) which a person is keeping or preserving for the purpose of their being shot.

 

(3) The second condition is that the person doing the stalking or flushing out-

 

(a) has with him written evidence-

(i) that the land on which the stalking or flushing out takes place belongs to him, or

(ii) that he has been given permission to use that land for the purpose by the occupier or, in the case of unoccupied land, by a person to whom it belongs, and

(:good: makes the evidence immediately available for inspection by a constable who asks to see it.

(4) The third condition is that the stalking or flushing out does not involve the use of more than one dog below ground at any one time.

 

(5) In so far as stalking or flushing out is undertaken with the use of a dog below ground in accordance with this paragraph, paragraph 1 shall have effect as if for the condition in paragraph 1(7) there were substituted the condition that-

 

(a) reasonable steps are taken for the purpose of ensuring that as soon as possible after being found the wild mammal is flushed out from below ground,

(:good: reasonable steps are taken for the purpose of ensuring that as soon as possible after being flushed out from below ground the wild mammal is shot dead by a competent person,

© in particular, the dog is brought under sufficiently close control to ensure that it does not prevent or obstruct achievement of the objective in paragraph (:lol:,

(d) reasonable steps are taken for the purpose of preventing injury to the dog, and

(e) the manner in which the dog is used complies with any code of practice which is issued or approved for the purpose of this paragraph by the Secretary of State.

you can use a dog to flush a fox out of cover ,to be shot,but cant allow a dog to go aground on a fox,unless it was by accident,but wearing a collar by accident wont wash, personally ,mind as my avatar says mate ,get him out . :good::good:

 

Sorry mate but your wrong.

 

You can use up to 2 terriers to flush a dog from cover or to bolt a fox from an earth to guns or nets but only if you are protecting game birds or livestock (your chickens). You can only dig down to the terrier if the dog or fox is thought to be in danger.

 

 

i stand corrected,bloody silly law ,confusing in it,contraditions about all the paragraphs.reason why i totaly ignore it all anyways :lol:

Well 2 foxes were in the goose pen tonight as we drove up the drive and they had killed a young goose which was laying. :good: Got within 35m with the 20 bore but they climbed over the wall which they were trying to get the goose over and although Dad immitated a foxhound quite well and gave chase with the gun they got away. :good:

Once you know the time they are visiting, you've got over half the battle. Find somewhere to hole up out of sight, that is within range and wait, do the same each day. You'll know when they are around because of the fuss the poultry will kick up. They'll be back. Just don't miss! :good:

All poultry is locked up now because of the foxes unless I'm there with a shotgun and the chickens only go in their houses when it gets dark so they can't go free range unless I'm going to be there 'til dusk. :lol: On the plus side I cycled several miles to where we keep our birds today and set a fox trap with the ex-goose. :good: Going back with BB's tonight and the 12 bore. We tried squeaking them in yesterday but they were not interested as they had their goose which was concealed from our view at that point. :good:
