That's news to me, can you tell me more, I know Scotland has a few differences but I've not heard this before. vulpicide Posted February 28, 2012 Report Share Posted February 28, 2012 Protection of Wild Mammals act 2002 (Scotland)the exemption s under para 2 sub sec 2 allows you to flush to guns the guns must be a firearm/or shotgun as specified or a bird of prey I spent two years going through all the evidence sessions in the Scottish Parliament as part of the NWTF team I am currently V. Chairman of the NWTF and still legally working my terriers. Because a captive bolt gun does not come under FAC or SGC it does not fit the legal requirement. If you get pulled with the police you give your name address and date of birth. Tell them you have been carrying out legal pest control do not elaborate or say anything else be polite decline their questions and tell them you will not answer any questions until you have spoken to a specialist lawyer. Obviously if you are a SACS member phone us and I will deal with it from there contacting our legal team and advising on your next move. A captive bolt gun is not legal in Scotland if you have used a dog a .410 pistol is as its a firearm as is a shotgun.Sorry the op did'nt say where he is. If questioned you would need to be able to provide evidence to this effect, ie that you were authorised and instructed by a keeper of gamebirds to enter your terrier to that fox. You can use anything to kill the fox as long as no cruelty is involved. Again your method would have to pass scrutiny and stand up in a court of law.
