SPARKIE Posted July 31, 2006 Report Share Posted July 31, 2006 today i was told that the person ive been buying my house of for the last 12 weeks has now decided they dont want to sell it im now £300 down and they wont reinburse me the £300 that i spent on the searchs and valuation on the property my solicitor said there is no law that states they have to compensate me for this so now i have to find a new house and move in within the next 6-7 weeks as my missus is having a baby in 8 weeks.has this ever happened to anybody else and if so did they manage to get any of there money back .my soliciter has been quite good about it they aint goin to charge me for it and they are goi to send a snotty letter to the venders.******** a very peed of sparkie .oh sod it im gonna take it out on the bunnies Quote Link to comment Share on other sites More sharing options...

Yorkshire Pudding Posted July 31, 2006 Report Share Posted July 31, 2006 Sparkie Try buying a business , spotted one for sale through a business agent , went to view , viewed again , got books , accountant looked at books , made offer to agent , which was accepted , went to bank , got provis on money , bank wanted a business survey , and a survey on our house , set a brief on . TOTAL COST £2700 . __ --__ ----- _____ Only to be told by the buisiness agent that sorry he misheard the offer and it was'nt 180k the asking price was 280k . No come backs , no grounds for compensation nowt . £2700 down the bin ... It's like a pre-contract contract but still does not guarantee full compliance and completion. It is good of your solicitor not to charge you for an abortive transaction which is outside of his / her control. I mainly do commercial work and only do the odd bit of domestic conveyancing for my special clients, but I can see that most transactions are very stressful and not worth it in terms of fee revenue - most conveyancing solicitors fees are less than the VAT charged by the estate agents on a transaction and we know how hard the estate agents work and how complicated their jobs are. See if you can sell them your survey report on the basis that it will help speed up their sale in the future. Oh yes, go and kick the estate agent in the nuts, he should have done a better job qualifying the sale and his customer. The Vendor will have to pay for a full property inspection and all the land searches before they can put their property on the market, so if they pull out they foot the bill not some poor sod who did everything in good faith. Erm as I said, "(s)he [the estate agent] should have done a better job qualifying the sale..." Most estate agents t's and c's say that they get their commission when they introduce a willing purchaser that can complete. The fact that the deal is not completed should not stand in the way of their commission. I wonder if the estate agent will be sending them a bill? Probably not because they should have had their instructions (and the sales particulars) approved and signed off by all the owners / interested parties.
