Devonhunter Posted November 14, 2015 Report Share Posted November 14, 2015 Hi all after some advice , i recently sold my .22lr to a guy who wanted sent by rfd , i took it to my rfd who booked it in and gave me the transferd firearm paperwork to say they have taken it off my hands , ive sent this into the firearms department along with a variation , my rfd have rang me to say they have sent the rifle off to the other rfd who has received it but they wont let the guy have the rifle as there saying i have to fill in his paperwork like its a ftf sale , ive done rfd transfers loads of times and once they receive it from my rfd they then transfer it onto the guys ticket themselfs . not sure what to do as the chap who bought has sent his ticket to my rfd who are now sending it to me to fill in but ive already sent in my transfer of fire arm form that my rfd gave me ! eddoakley Posted November 14, 2015 Report Share Posted November 14, 2015 Speak to your feo but it is supposed to be done the way that the buyers rfd has told you. As an rfd I have to inform my firearms dept of the person who pays me for the gun not the rfd that I send to. I have to have paperwork sent to me to fill in and then send it back to the buyer to be able to collect his/her gun. It causes no end of problems. For example I sold a gun last week to a guy who didn't have a slot on his ticket for it. To solve the problem his rfd sent me the money so I technically sold it to the rfd. Why ?, when he is complying with the correct procedure. Have a read of your FAC where it clearly states the correct procedure for remote sales. Any advise ?? Been through this, checked with FEO and with the advice from BASC. The law is very clear and the notes on your FAC (note 4 I think is the key one) states that the RFD is NOT to complete the table for the buyer, you have to do that, as you are the seller. The FTF is with the RFD at each end to satisfy the FTF condition but as the seller, YOU have to ask for his FAC and complete your details as the seller, then send it back to him. The other RFD cannot release the firearm until the buyer can show in his certificate that he has a slot with that firearm on the table, signed by you the seller. It's really very straightforwards. The trouble is, loads of RFDs offer to accept firearms and give you a receipt saying they have taken the rifle from you but that is not the same as transferring ownership unless you sell it to one RFD, they transfer to another and the buyers RFD "sells" the firearm to the buyer for a nominal £1 or whatever, with the main transaction done by you behind the scenes with the buyer. They are responsible for spreading the confusion in many cases or that's the way it seems. A lot of that goes on, but check out the small print on your FAC and you will see that it is crystal clear how the transfer should be done. Whether some agree with it or not is totally irrelevant, as it's the legal requirement. The GTA also back BASC and the police services on this.
