It is pretty obvious if you have not filled a slot by the expiry date of the FAC (assuming it was there from the start) then you may have some issue justifying it's continued existence.

 

I've not heard of anyone losing a slot "mid term" as it were, but who knows.

 

There is no legal time limit that I am aware of, but you only have the slot because you have some sort of legitimate requirement/need, so if you don't fill it be prepared for this need to be questioned!

In law, until renewal. In practice, some counties can get quite arsey and chase you up to buy or lose the permission.

 

So it depends on where you are. I have empty slots over 2 and a half years old.

 

 

Ok, I hold my hands up, I missed this in the Firearms legislation somewhere, point me in the direction of the law that says you lose your slot if you don't fill it by renewal.

in essex, I would imagine you'd loose it, after our FAO quotes if you dont use it, you'll loose it, on giving you your FAC, therefore if on renewel 5yrs later you havent bought one, Id reckon they would remove it :hmm:

I agree Stubby as I said in post4 here, but this chap said you will lose it LAW, just interested in the section of any law that says this, as it's new to me! :good:

It does happen and is lawful but can land the Chief Constable in a Judicial Review.

 

 

Thanks for this, but the words used are MAY, not will, and it doesn't mention renewal, as far as I'm aware there is nothing in the law that says you WILL lose it at renewal in not filled!

I have recently renewed my fac I sort of fancied a .223 purely for fox so put a variation in at the same time, but as I have a .243 which does the job I still have not quite made my mind up, so as far as I am concerned as the slot on my ticket is eating nowt I have the best part of five years to make up my mind one way or another.

Agreed but neither the OP nor myself used the word WILL.

 

An individual "permission to acquire" cannot last beyond the duration of the certificate and is sometimes less. A renewal requires of the police to review all items and issue a new 5 year certificate based on its own merits.

 

In practice overwork often makes them just rubber stamp it.

That's twice you've claimed I've used the word WILL, why do you keep doing that? People only have to scroll up to see otherwise.

 

1) The OP asked about his FAC which is 5 years, then it stops, no longer.

2) Police have complete discretion to cut all or part of it short.

3) Police may issue a new 5 year certificate after it with the same or different details on it. This makes it not the same certificate but a new one. There is no rollover.

 

The OP, expert-itsgoodtobemodest, got an accurate reply from me which he's happy with. I'll end it there now.

I would have thought it might be better to Purchase the 222 asap,I say this because when you had your interview, were you not asked why you NEEDED the 222

 

they may just look at it, as if you dont really need it, then why keep it on there

 

I had my interview the other day and had to explain the use for every one

I gave my reasons as........

22LR ....short range rabit and general work horse

17HMR....Long range rabits and short range fox (fox allowed with 17 here in Devon)

222 long range and general foxing rifle

 

these were all granted with the clause that i have to have a mentor for the 222

I will be looking at filling all 3 spaces within 6 months,.........hopefully, this will show the Need for all 3

I must be getting confused, it seems you are suggesting that he has a maximum of 5 years to fill a slot because that is when the FAC expires.

 

You state that is the law, presumably because we all have to go through the motions again at the end of 5 years.

 

I don't see that is relavent or helpful to the original question, if he put in FAC a variation and was granted it at 4 years and 51 weeks I don't think there would be any problems at all justifying it on the new FAC.

 

I'm not looking for grief, I am just lost why you keep on about the law, because, other than the fact the certificate expire after 5 years there is NOTHING in law that says you cannot get the same slots on your next FAC if you have not filled them.
