False accusations in work.

I'd go to acas or citizens advice, if the police do get involved you could go down the line of slander defamation of caryter, making up false statements ETC. You will need to follow the company procedure tho, do it by the book keep all emails and send a copy to private email address, if she gets involved then she would be breaking the dignity at work/ grievance procedure , all this needs to be document.

 

 

Do NOT send to private e-mail address. Probably breaking company policy and gives them reason to fire you.

The minute they dismiss me they will change the password on my works email and I will no longer have access to it :look:

 

What do you suggest ? Surely I am allowed copies of emails sent TO and BY me ?

Sending work mails to a private address would be ok if you could demonstrate there was no other way to safeguard your position and you were in genuine fear of a cover-up, and the company was acting in bad faith.

 

People usually fall foul of this when they're nicking commercially sensitive data such as lists of customers.

I am going through a tribunal case at the moment. I am a witness on behalf of the company. We have been requested to provide ALL copies of ANY emails to and from the person concerned going back to the start of their employment (5 years).

 

In your case the company would be asked to present the e-mails themselves. If they wouldn't/couldn't then that would strengthen your case.

 

I am due to attend a 9 (yes 9) day tribunal in April. Oh joy.

Very conveniently after I continually pushed and pushed for further investigation and Police involvement all allegations against me will go no further.

 

Not to happy though as they have not withdrawn the allegations, simple said they don't want to do anything about them :/

 

However have been told I will receive no warning or anything and no mention of it on my record.

 

... wonder what they will come up with next week :no:

Sorry to hear about your trouble, I have had employment issues in the past and luckily I won..... but only because I had legal cover on my home insurance policy that actually contained Employment Conflict cover & legal protection cover...... without any excess to pay & I received some good advice - keep cool and research every comment/statement sent/received.

Could be worth a telephone call to your insurer....

 

Back to the soap box: I have read through the thread posts here and there is some good advice & some poor advice.... My only advice is to seek "professional" help. Citizens advice "advised" me to get professional advice, but also informed me of time limitations for appeals & official procedures etc etc which I knew nothing about. It was through this that I stumbled on my house insurance route & the right to have an appointed colleague to provide me with support in meetings and tribunals (very intimidating on your own).

 

It is "reasonable" that your employer offer you evidence for any possible wrong-doing & if you can prove your innocence with police involvement then that is your right. My false accusation was dangerous driving in a company vehicle..... Yet no-one could provide any "acutal" evidence, apart from a complaint letter from a "senior manager".......... the police confirmed the CCTV footage of the "alleged incident" showed "no abnormal vehicle activity from that particular camera at the requested time!"

 

Final note: If they want you out, you will eventually lose your job, that's life.

But for now, prove your innocence, clear your name & negotiate an amicable departure with a glowing reference and move on??? I currently run my own business (I wonder why?), in my 4th successful year now.... No boss but the wife........
