Fixed Penalty Speeding-Legal advice

Got caught by a fixed camera back in April doing 58 in a 50 limit and after reading the NIP I opted to pay the £100 and take the 3 points-the offence was clearly written as SP50.After receiving my licence back today I noticed that the offence is now written as an SP30-the wrong code and thus the wrong offence. I rang DVLA who confirmed that the offence reported to them and on my driving record is an SP30. So my question is-I have been found guilty of an offence that I was never charged with and punished for said offence-should I get the caser overturned?

You need specialist advice because the offence you were caught for was 58 in 50. it wasnt fifty in a 30 or 58 in a 30. I suspect the police will claim an admin error. You are very unlikely to get off, so whats worse speeding in a 50 or speeding in a 30? I'd simply write to them and advise they have documented the wrong offence which you were not guilty of and ask for the points and notice to be removed from your licence. They will probably correct it but its worth a try.

 

Do however seek more knowledgeable advice.

If the fixed camera that caught you was on a motorway - through roadworks or under variable limit stretch then SP50 is the correct code. SP50 is a motorway offence code only.

If not it might be worth getting legal help to ask for an incorrect penalty to be removed. Maybe start at your local citizens advice as it's free ?

SP30 is for exceeding the Statutory Speed Limit on a Public Road

SP50 is for exceeding the Speed Limit on a Motorway

 

Were you in a Temporary speed limit area on a Motorway?

 

Either way SP30 appears to be the correct coding (SP50 would be applicable on a national Speed Limit Motorway) the 50 may have come about as the location of the camera was stated as being on a Motorway and the code was auto generated as such.
