Gordon R Posted April 17, 2012 Report Share Posted April 17, 2012 (edited) What if I have not heard anything within 14 days?The obligation on the prosecution is to show they served the Notice of Intended Prosecution 14 days or less from the offence. The day of the offence is not counted in the calculation. They do not have to show you actually received it, so the general rule that post is deemed to be served 2 days after posting applies. If you move house or buy a vehicle and do not register the change of details with the DVLA then the notice will go to the wrong address. As it was due to your default it does not invalidate the notice. Also, if you were driving a company or hire car the notice is sent to the company or hire company. It can be weeks, if not months, before you find out about it but again this does not invalidate the notice. If the reg keeper takes 14 days to respond then that is no get out for the actual driver. The keeper has 28 days from the date of service to provide the information. It's actually quite a shocking state of affairs because you are served with the notice as soon as it is posted by 1st class post. Therefore, you may not know for several says that you have a time limit running against you. You could of course use it to your advantage. If there is a mistake on the NIP which is serious enough to void it then they have to rectify it by sending a new one before the 14 days is up. If you don't tell them they they can't do so! J. I dont think that the firearms teams just check PNC.....i think they check all their indices and that would be where your details on that ticket issue came up......unsure why the FEO felt the need to mention that as he would know it was your wife(ex) that was driving, but again you being of un-sound habits and co-habiting with a known criminal (your ex-wife the speeder) could be used to revoke any application. (all the above is in jest) Please let us all know when you get your SGC.....i am sure you will, it was an honest mistake, something forgotten and not mentioned, unsure why it is taking so long, i have a friend who works for a firearms licensing team and believe the caution was only given to ensure that if you said anything incriminating they could use it.......as you answered honestly and showed no criminal intent (mere stupidly forgetting) i doubt that it will result in a charge also.....once that decision is made then the SGC should follow Quote Link to comment Share on other sites More sharing options...

It wouldn't take 10 weeks to decide whether to charge you....they've got all the evidence they need to do so if they wanted to.
