welshwarrior
My wife has bought some jumpers on line that where discribed as generously sized well one is huge one is tiny, she wants to exchange them for a better fitting pair, the shop wants her to pay for all the postage (which is at a very high rate). Now I'm sure Ive read on here under distance selling she's not liable for the postage is this right if so do you have a link the document that says so. robbiep
http://www.which.co.uk/consumer-rights/regulation/distance-selling-regulations#link-8 From that page : The seller's terms and conditions or returns policy should state who pays the cost of returning the item. aris
If faulty or not as described, they must pay. In this case it sounds like a bit of a grey area.
rovercoupe
It used to be the case where shops would have to pay return postage and you could do it as many times as you liked but then it was changed to, you must have a returns policy. I normally ask the customer to pay the return cost and I pick up the cost of re sending.
SNS
You have 14 days from receipt of goods to cancel the order under the Consumer Contracts Regulations. The shop has to refund the basic cost of getting the goods to you originally. As for postage on their return - have a read of their own t&cs. Some will refund it, some won't. But then you'll have to pay postage on the new order for the replacement item !
welshwarrior
Thanks guys he's just agree to send out the replacements FOC once he received the odd sized goods. He claims his charges are so high as he does next day delivery, but hadn't on our last parcel and it took 3 weeks from date of order to arrive! marsh man
They do have to pay return postage if it was faulty or significantly not as described. Do that apply to Ebay as well ? . I bought a bag which was wrongly described and damaged , at first the lady only wanted to pay for the price I paid for the item and not the postage , after complaining she agreed to pay my first postage but not the return postage , so to save a lot of hassle I agreed . I got my money back which was £15.00 but I was £4 .00 worse off. So not having done a lot of buying or selling on Ebay do I do right or wrong ? ..........Thanks
casts_by_fly
If ebay was a private individual then there is no recourse under the sale of goods act. It comes down to ebay policies and trader feedback (your leaving them feedback) generally determines what happens. People who care about their feedback will be more amenable. If the ebay purchase was from a shop, then the same conditions apply as above. rick
