russ91 Posted March 26, 2008 Report Share Posted March 26, 2008 right guys the guy next door has asked me if i will shoot the rats that are eating the chicken food on his allotment he has also asked the comity of the allotment and they have given him permission for me to go on there but the allotment is over looked by some houses and i was just wondering were i stand with the law if some one from the houses phoned the police saying there is some one shooting on the allotment. As long as no pellets cross the permissions boundery and into their garden you shopuld be fine. But get written permission and show the police if they do show up. DaveK Posted March 27, 2008 Report Share Posted March 27, 2008 It's not necessary for the landowner to give permission. The allotment holders are tenants and have an obligation to control vermin. Therefore you can do it on their behalf. Shooting rights apply to game species and not to pest control so it doesn't matter who has the shooting rights. The landowner (especially if it's the local council) may have a clause in their tenancy agreements that may stop you doing it but I'd have thought if the allotment committee has said okay and you get written permission off them then you would be in the clear if later it was found that you shouldn't be doing it. You would be doing it in good faith. Get insure. get it in writing and get shooting. As it's close to houses it would be in your best interests to phone the police control room and tell them what you're doing and that you have written permission to do it. They'll ask for some details but at least if they then get a call from a householder about shooting near their house the police can say that they know about it and it's on the level. If you're a BASC member or with some other organisation, give them a call. If you're not then join something. You NEED the insurance that will be provided.
