ROBLATCH Posted July 8, 2007 Report Share Posted July 8, 2007 wel today i received my first fine £50 since the smoking ban started.i own a holiday home at flamingoland which i sublet and one of the current occupiers was having a cigarette in the living area when mr gibb (the owner) popped around.i was welcomed with a lovely call from him with an explanation of ! robert one of your customers were today caught smoking in your holiday home ! when i asked the result he said a fine to you for £50 and be advised that your holiday home must be equiped with no smoking signs within 7 days or your holiday home insurance is void and it will be removed from site. beware holiday home owners you CAN be fined Quote Link to comment Share on other sites More sharing options...

I can't imagine any law that allows this "Owner" to collect a fine from you. Check the small print of your Agreement with him and if you can't find anything to support his claim, I would ask him to prove it. pin Posted July 9, 2007 Report Share Posted July 9, 2007 I think he's on the make trying to exploit a new piece of legislation which isn't at all clear in people's minds yet. Whilst I agree he could be fined, I don't think he's got the right to fine you [ under the new smoking ban legislation ]. Obviously he's quite within his rights to impose contractual terms upon you which if you sign it's likely he can hold you to, assuming the terms are not grossly unfair or illegal. death from below Posted July 10, 2007 Report Share Posted July 10, 2007 I'm a non smoker and all for the ban.....but a holiday home is just daft.....how on earth is that a public/work place......I think Mr Gobby requires a swift hoof in the family jewels......i wouldn't fancy being one of the council snoopers going into pubs to catch and fine people.....I can see a few of them getting a pasting.....just like council parking wardens. paulos Posted July 10, 2007 Report Share Posted July 10, 2007 from what i was led to believe, holilday homes were not covered by the ban, as they are temporary residence, as long as its made clear that it is a smoking house. simalarly, hotels are allowed to offer smoking rooms, as they also constitute as a temporary residence. might be worth checking up!
