Guns Taken By Police

You weren't reported to be pointing it at anybody if so I think the response would have been different

well the person who phoned to police on me said they saw men with guns, but I know that wasn't true because my shotgun was in a slip until I was in a copse of trees out of sight.

they probably just heard shots and decided to elaborate a bit.

There is no laws in UK or EU DIRECTLY ( yet ! ) about lasers. Unlike Australia where all lasers over 1mW are forbidden in consumer hands and treated as weapons.

In UK Health Protection Agency legislation recommends that laser pointers over 1mW are not to be available for purchase to general public , we comply to this by NOT SUPPLYING LASERPENS OVER 1mW FOR GENERAL PUBLIC / CONSUMER USE ,and only supply modules / hand held lasers for legitimate uses by proffesional organisations and we actively manually check each and every order , and record each individual laser purchase over 1mW

The law treats higher power laser pointers ( greater than 1mW ) like knives, hammers, swords etc.The law does not want to see lasers carried openly or used openly in public without risk assessment and safety considerations .Although point any laser product high or low power , laser pen or module at aircraft and there is offensive weapon legislation that will imprison you.

If you have a legitimate use you are entitled to purchase and own and work safely with lasers but like knives asnd many other products they are potentially hazardous so purchase and use controls are recommended by health protection agency.

Hope common sense prevails, obviously you regret your actions and you have not committed a crime, you must let us know the outcome. I check my lamp direction when its attached to my rifle from my utility into the back garden, luckily I am not over looked by anyone and I think that most of us have done something a bit stupid at sometime or other in complete innocence. I would like to set up a little rifle range in the back garden for my son and his 6ftlb gammo air rifle but incidences like this make it just not worth it. My brother in law is in CID and he tells me plenty of tales of what happens with armed response, apparently my county has three teams on the constant move on standby for a call and I'm quessing some sort of protocol is engaged when put into action whether is a innocent lazer or a nutter with a semi, and if you think of it, it can only be that way.

Goodluck olde mate anyway, sure you won't need it.

I have worked for them for 7 years and i work in the control centre (makes it worse when you think about it) But as per BASC they had no warrent and had no rights to remove anything this was 2 hours after the call i have not been arrested as i had not commited any arrestable offence (just been stupid is suppose)

as far as i know they dont need a warrant i thought one of the conditions of a FAC is that if an officer asks for your gun you have to surrender it not to is an offence on it`s own.

I'm a bit confused here

Were the laser and sight actually on the gun, or had they been taken off?

In the original post he says that yes at first it was on the gun and as it was taking time to sort so he removed the scope and laser and sorted it that way, by which time I'm quessing the damage had been done.

hate to be a bad omen but i think the op is in for more than a slap on the wrist.he has already admitted to pointing the rifle out his front door on an open forum.

the fact that they have siezed the guns means it`s going to be a hell of a fight to get them back and not in the near future.

Fingers crossed eh some times you wish you could turn back time, i have to say the firearms guys were not heavy handed and i stayed calm and polite and was helpful it made a bad situation a little more tangable and i think that also helped. i no how i feel some days when jo bloggs gives me a hard time over the phone, I thought i would share this with members because sometimes its the things we don't think are a problem can be blown all out of proportion.

so if you point an unloaded rifle out the front door, what laws have you broken? causing alarm and distress?

before anyone jumps in I am not suggesting that people do it. just interested.

Thats not the point! Are you not aware of the Dunblane/Raoul Moat etc style rampages? The general public dont know if a weapon is loaded or not

You wouldnt walk into your local pub on a weekend waving a firearm about, loaded or not. It boils down to the same thing

No as per BASC firearms department unless they have a warrent or you have discharged the weapon or commiting a breech of the peace then they can not take your guns.

I asked for a reciept and was told they don't give one The Rifle wwas Never in the public eye at the start i opened the front door and i was in my front room which has no direct line of site to any windows it was after i removed the scope i went to towards the door it was at this point i believe i was seen. The lazer moving around had already drown the attention of the person across the green.

ok, what happens if someone sees you getting your rifle out of your car then.

just saying.

I don't think it's helpful to compare six hills to raoul btw.

It would be in a slip, wouldnt it?

and I didnt compare anyone to Raoul. I just asked if you were aware of what happened in the Raoul Moat scenario.

with a bit of luck in the cold light of day they might take it for what it was a silly lapse in judgement and they acted on the side of caustion just to be safe.

a silly lapse in judgement? what if he has a silly lapse with a loaded weapon :hmm: surely they will look upon it as a person not fit to hold the relevant licece. just my point of view.

So you had the rifle in your front room, pointing it out of the open front door and onto what?

The house opposite? The green outside your house?

Then you removed the scope and went to the front door without the rifle, and that's when you were 'spotted'?
