He has just installed a wood burner and the smoke is coming into my parent's garden. The chimney is not very high. Am I right in thinking that the chimney should be as high as the main roof? Before getting ours installed the company checked and made an assessment of the neighbouring houses and style of chimney pot etc. However it is not uncommon for cowboys to fit wood burners on the cheap without going through the right procedures. The neighbour is a hateful man,along with his whole brood, and knows my parent's won't say anything. Me? that's another story, so I want to get my facts right before I approach him. clakk Posted June 20, 2014 Report Share Posted June 20, 2014 go to enviromental health if he,s a gimp cry havoc and let slip the dogs of the council.my missus used to have to put up with similar from a stinky chippy till her dad got the enviromentals on it.theres building regs n allsorts on chimneys so the local building inspector can be involved as well.get the old heart strings going about elderly peeps health being ruined breathing in smoke.also how the smoke makes their home stink.if you approach the council nicely theres a whole heap of dog drops u can lob at mr perfict if you ask them b4 you may not have to speak to the creature as theyl do the dirty work for you.if he decides to have ago at your ma n pa log every incident and report it to the police and get a crime number.he can try and be a tit about this and you may want to just replace his teeth but the law is on your dad n mums side so you dont have to get confrontational just use whats already in place atb Quote Link to comment Share on other sites More sharing options...

I know that some built up areas are required to use smokeless fuel only so there are definitely regulations that he needs to follow. FalconFN Posted June 21, 2014 Report Share Posted June 21, 2014 I think that if the chimney is a certain distance from the main roof (I think it us around 3 meters) it only has to be a certain height above the extension roof. Also, due to obstacles causing turbulance, it us not uncommon for smoke to end up at a lower height than the chimney or even to settle in certain areas even if all the regs have been followed. Fisherman Mike Posted June 21, 2014 Report Share Posted June 21, 2014 To comply with Building regulations the flue outlet should be above the level of the main roof ( not necessarily the ridge line ) and in such a position so as to safely discharge products of combustion without danger of ingress in to the building an adjacent building or causing a nuisance or risk to an adjacent occupier. I would be tempted to go the building control route first, they will often inform the LA environmental health inspector and arrange for a simultaneous inspection.
