Advice on returning broken gun?

I have posted this here for advice on the situation, not the gun so was hoping more people would see it in this section. ok so by now some of you have probly read about my devil hatsan on it's first ever shoot since buying last week. so here is the deal:

 

on Friday before college I will be returning it to the shop. I don't want another one, I don't want it replaced and to be honest I should have bought a beneli off a member on here.

 

but when they was looking at it and witnessing it double firing jamming and misfiring on Saturday I said " I would happily just get a refund, add money to it and by somthing else from your shop" at wich point he replied with, well we will just replace it, I explained that I don't want it and he said well they will send it back to the importer wich may take a while and then they will issue a new one that I can collect?

 

Was he missing the point here on the fact I simply want my money back? Or is that not how buying a gun works? Bare in mind this is the same man that came out to see the gun misbehaving with his own eyes.

Just tell him you want a full refund. The gun wasn't fit for purpose, which he's witnessed, and that it's put you off buying another. I'm sure someone will put up a copy of the sale of goods act for you.

so it being a fire arms as such doesn't change anything? It's broken and I get my money back? he said they have to send it back first? I was under the assumption this isn't my problem and that on Friday thereby I hand it back in the box that by rite I can get my money back?

Take a letter with you rejecting it in writing, you have explain using the terms in the act that it is not "fit for purpose" and "and not of satisfactory quality" you request a refund (if you paid by card you may some extra rights through the card issuer. You cannot return it because you don't like it but you as faulty if they won't play ball give the manager the letter which states you have 7 days to issue a refund or you will file a small claims court claim (this can done online for £20 ish

brilliant help lads! appreciate that. So last thing cutting it plain and simple. They don't have to have it certified broken or anything? Now they have witnessed it I hand it to them, ask for refund and by law they have to refund me yes?

Wait till the shops full and then go in,they wont know how quick to get rid of you.Did this with a 3 peice from the dreaded FCS.Took it back through on a Saturday in a transit after being bull****ted on the phone for a week.I set it up righf outside the door and told them I would show people the **** they sold.

Five minutes later I had my refund & three overweight salesmen sweating their tits off trying to get it round the back.

I wonder if a phone call to Havering trading standards first might help , then if they do try and BS (sadly I've had experience of this with SX gun ) it's already on record . A quick phone call from the shop may help.
