Don't want to sound sexitst, but **** it, if women want to play on the same playing field, then they have an equal share of everything, yet kids always get placed with mothers. Positive discrimination they call it, class one liberty I call it. I beleive that it depends who is the 'Primary Carer'. Whoever is the Primary carer gets maintenance from the secondary carer. I have not half the horrow stories that you guys have been sharing as I the plit with my ex was fairly amicable. I worked out how much I shoudl pay her and she accepted it. I even filed my own divorce papers with some help of a pal of mine. After agreeing that I have my son 2 days in the week plus every other weekend it worked out that I had him average 3 nights a week and she had him 4 nights a week. However I still ended up paying over £400/month. I could afford it, but the overall devorce hammered me. Just about starting to recover now in reality - nearly 7 years later. I would highly recommend that anyone avoid the CSA and make their own arrangements that are then writetn into the divorce agreements and singed by both. However there's nothing better than having an amicable relationship - that way any changes can be discussed. We even have Christmas lunch together (my and my wife and the Ex) have done for the last 3 years. I was more scared that I'd pay the CSA and only a portion of it would benefit my son. At least this way I can see that my sone can enjoy her designer jeans and shoes !! I hope the government sort it out soon!! It's a mess the CSA. Loui Think what you`ve got there is a joint custody arrangement, but she gets the family allowance and the extra night. Primary carer. The fact that you`re still paying 400 a month is just plain wrong. My arrangement was similar, but i gave the ex £110 a month for the extra day, really cos it kept things sweet, not because i thought she deserved it as i bought the kids clothes, uniforms etc. She generally spent most of the money on herself. The one time she tried to have me over was when she started seeing some idiot who said i should pay her more. I spoke to the CSA and explained the situation in full, there was no point in not giving the full story. They said £110 sounds right. Thats pretty much what we would award. The old boy whom I was articled to many years ago was a very old school solicitor - he would do Divorce work but if his client started playing games of chess with the kids he would show them the door - I think the expression was "you require a service of this firm it is neither able nor willing to supply". miffy Posted May 1, 2007 Report Share Posted May 1, 2007 I got in touch with the CSA when i split from the ex and explained that we had split up and where i was working etc. etc. Then 3 years later they told me i had 13'000 ish in arrears to pay so i contested the amount because of the time they had taken to make the decision, so they very kindly dropped it to around 11'000 Fairly recently they put a detatchment of earnings order on me and stopped £550 a month at source i offered to pay a realistic amount but they said you are paying the lot and there is nothing that you can do about it, even though i pointed out it wasn't worth me going to work. Not long after that i gave up my job and went to work another company and now i earn less than my protected earnings rate. I still get grief of them but there isn't much they can do I had a letter the other month explaing that a debt collection agency were being brought in to recover the debt if i dont get in touch within 7 days When i spoke to them on the phone (it's always a woman who answers when i phone) i explained that i now earn less than my monthly protected earnings limit and that i cannot afford to pay anything I don't let it stress me out anymore as i know i will always earn less than the protected earnings limit that they set for me Quote Link to comment Share on other sites More sharing options...

I wish I knew how, and had the funds to do it. How come this didn't make breaking news? And has it set a precedent for similar cases? Andy W Posted May 2, 2007 Report Share Posted May 2, 2007 Christ guys, you lot have certainly had it bad, my wife divorced me and we remain friends to this day. I started paying maintenance through the courts before the CSA was set up, when CSA did arrive they assessed me and made huge demands on me, I never filled in the paperwork and has luck had it I moved house shortly after that and changed jobs twice but never missed a payment to my ex wife, my daughters would not see me but I still had to pay. As my ex wife was on benefits they were pestering her to tell where I was working and living, she knew but said she did not or else she could of dropped me right in it. The last stroke they tried was by telling my wife that they were taking over my payments and instead of me paying her directly each week cash they wanted it sent to them and they would pay her, she spoke to me about it and I said no, the system that we have has worked fine all these years, I have never missed a payment and the girls have never suffered and on top of the maintenance payments I also used to pay for holidays, clothes etc. In the end they gave up as they would of caused mucg upset between me and my ex wife and I would of without hesitation dissapeared. When I first got divorced my solicitor after paying off my ex wife advised me to sell my house and buy the most expensive house that I could afford on a mortgage which I did, the mortgage represented over half of my monthly basic wage and with maintenance and food on top used up all my wages, I have always worked a lot of overtime which helped me out no end, at one point of the saga the company which I worked for tipped me off that the CSA were making enquiries about me and by law they had to give them the details, I left the company there and then, the paperwork was filled in that I no longer work there, 6 weeks later I was back again. I no longer pay any maintenance, I paid for my youngest girl until she was 17 and my oldest girl until 19 as she was at university. I really feel for you guys. And has it set a precedent for similar cases? dont know if it set precident, he was working for CIS, they said he was self employed, his accountant said he was self employed, the tax man said he was self employed but the csa said he was classed as employed and clobbered him on payments. funnily enough he went onto do law degree and masters, first hon in both !!
