New Brexit legal challenge

Was this the Nigerian woman who came over to the UK to have her multi birth IVF babies? Because she couldn't afford medical care to have them in Nigeria, sadly the father couldn't be with her....because they couldn't afford his airfare?

Come on guys it's only £500,000, surely we can afford to pay her partners airfare and temporary full board expenses in a posh London Hotel whilst they are here having free healthcare on the NHS?...............that is if they ever decide to leave the UK and go back to Nigeria?

While i hate health tourists, as i understand it she went to usa, but was refused access as they thought she did not have funds for their health care,she was put on a flight back and went into labour when transferring in the uk.

The airline that let her fly should be the ones footing the bill in my opinion.

Its going to cost us a lot more than that! Think about it for a moment, now she has two British born babies. The babies are British, they can't be deported, the mother now can't be deported because they can't split the family up so she is now on a fast track for a house, benefits for life, the whole deal. The father will be here soon enough don't you worry

Its a big immigration scam, African women are coming in droves to this country to give birth, not to get free NHS treatment, they want a British born baby. Many of them give birth at St Georges in Tooting

And just why can't we do something to stop it Now?

Probably our authorities believe the lying Doctor who signified she was not beyond the date whereby the airline could refuse to carry for safety reasons?

Quite a well known scam from what I understand but can't verify?

Everyone but us seem switched on?

I'm not sure about this British born babies having the rights to remain as UK citizens if both parents are Nigerian and neither have British passports.

What I would like to see is implementation of compulsory health insurance for all non-UK nationals arriving from countries with no reciprocal health payment arrangements.

You can take my word for it, my step daughter has been a midwife at St Georges in the recent past and it is happening on an industrial scale. Within hours of the baby being born the immigration lawyers are at the bedside filling in forms. Its not a random event its an organised racket and its been going on for a long time.

Not sure that's correct, then again I hadn't given it any thought TBH. I did a google search and came up with this from an immigration site:

Prior to 1 January 1983 almost any child born in the UK automatically acquired British citizenship. Since then the rules have changed. A child born today in the UK will only have British citizenship if at least one of their parents is a British citizen or was living in the UK with permission to stay here permanently.

Children Born to Citizens of the European Economic Area

Children born in the UK to citizens of the European Economic Area may be British citizens depending on when they were born. Children born:

From 1 January 1983 to 2 October 2000 will be British citizens if either parent was living in the UK at the time;

From 2 October 2000 to 29 April 2006 will only be British citizens if at least one parent had obtained indefinite leave to remain or the unconditional right to permanent residence in the UK prior to the birth;

On or after 30 April 2006 will be British citizens if at least one parent lived in the UK continuously for five years pursuant to their rights under European law prior to the birth.

It might be out-dated for all I know, but I'd be surprised if a loophole as described was left unplugged.

I can't believe some of you guys! Really, don't you think these people deserve help?

Why oh why be so mean. These people deserve compassion we have the resources and ability to look after them so why not????

I can't belive you are being serious, surely your joking. If your not, I've got an idea, if you want to help, you can give away as much of your money as you want to anyone who needs it, why not give all of it and your house, childrens money to if you want, you can then leave the rest of us who don't want to fund the whole world's problems to decide what we want to do with it.

I don't know anymore about it than what I have told you but I do know these applications and subsequent appeals can take years, decades sometimes. During which time no doubt the lawyers will be creaming off the legal aid bill for everything they can get.

I think it would be very difficult for the courts at the end of the process to justify deporting a twelve year old child who was born here along with their several younger brothers and sisters who were born here subsequently. You don't hear about it happening.

I suspect the courts are more likely to "bottle out" the longer it drags on, and a face saving "compromise" is reached.

In Israel all immigration decisions are made within 48 hours by law. Unless you can put clear and compelling evidence on the table on day one you are back on the plane on day two. And everybody knows the rules.
