is it possible to sell guns if police has seized them?

Unless something strange has happened you are still the legal owner, even if your certificate has been revoked.

 

IF your certificate has been revoked you can have no direct involvement in the sale/handover, but the Police can/will make the transfer to the purchaser.

 

Not knowing specifics I can say no more, sounds like you are getting legal advice, which would be my suggestion! :yes::good:

I have spoke to police today theres no problem with putting guns on my mates ticket. ive got to put it in writing and they will contact my mate to collect them. I spoke to a solicitor tonight from NGO and hes advised me not to appeal he says it could end up costing me 6 grand!. he says im best off just leaving it 2 year and putting back in for ticket. he says durham police are worst in country these days for getting your ticket back on appeal

Tell the NGO man you dont want to wait, if you've done nowt wrong then there is no reason you should not have you ticket back asap!

Am I correct in assuming you actually did assault someone but all charges have been dropped, and this is why the NGO have advised you to wait 2 years rather than appeal?

Or were you just accused of assault where no assault took place?

was that the man from NGO or the solicitor? was solicitor paid by NGO?

no never assaulted anyone was accused by some lass whos been giving me greef on fb for years. her hole family are idiots! there was some words exchanged but no assault. she got 2 of her mates to to say I did but I have 5 people to say I didn't so that's why police dropped case

Police have unlimited resources, and no consequences if they lose. This is why being a member of BASC can be handy, if not for the advice of the ex-FEO's they have on staff, but the new legal cover too. This could happen to anyone.

Then I can't understand why the NGO have advised you to wait 2 weeks let alone 2 years, after all, you will be no more innocent in 2 years time than you are now. Perhaps a change of shooting representation would be in order.I would be searching for one with some balls.

Have you considered suing those responsible for making the false allegations?

hmmm seems odd i can see it being that money if it went all they way to court (that would only happen if police were confident) although durham have a poor record

after reading that your looking at 36 weeks for your appeal to be heard!! what makes me laugh is the hole six month durham police have had my guns ive had my shot gun ticketin house!! so if im such a risk to public I would of went and bought another gun and shot some body!! they are totally useless

You still have in your possession a valid SGC??

 

But the police will not give you your guns??

 

So give the guns to your mate that the police hold, and he can give them back to you!

 

And the legal advice is forget them for 2 years? :hmm::hmm::hmm::hmm::hmm::hmm::hmm::hmm::hmm:

If they haven't revoked your ticket in 6 months then why would they now? Your ticket has not been revoked, they want to you go away quietly and not be any work.

For all i know you could be the next Atherton.... Durhams procedures have been found seriously lacking in the past, as shown in IPCC report, but that does not mean they can make it up as they go along! As others have said you can represent yourself and win.

the reason it took so long the officer dealing with case went on long term sick so it took them agers to get another copper on job

 

SO basically it was a slow priority as it could be and they just want you to drop it? I suggest you write a letter to Chief constable, copy in the PCC, explain the situation about the malicious accusations, the lack of any charge or conviction and explain you are taking legal advice and wish to have your guns restored you within 7 days, give them 7 days to respond to the letter and take it from there. Get letter checked by a solicitor or drafted for £100 ish and see what happens, suggest you contact your shooting organisation and seek their advice. BASC have the best dept but if this all happened prior to you joining i don't think they will be able to do much.

Sounds to me the revocation will be on its way I'm afraid ! The best thing for u to have done was sign ur guns over as soon as this happened ! And write a letter to chief constable you have done this and both sign it therefore making u less risk ! And possibly making yourself look better in the eyes of the police!

It all sounds a big mess for you and I hope u get it sorted out

All I can say is if you have no revocation letter which allows you 21 days to appeal you have not been revoked !

I am at this moment in a simila position with Essex police, they have decided to revoke my fac and sgc for harassment to an ex over 4 years ago to which I must add was not true hence why the case got dropped .

Essex police have visited me twice in them four years once to change address and once for renewal so why did they not take them then if I was a danger?

They have also lied there back teeth out saying that they could not find me when I was on bail for five months yet in that time I went to court 3 times for ajurnment and to the police station at least twice one of which was for permission to go on holiday which was no problem the court is aprox 100mtrs from the police station, it's a joke...... But not for me as I have sent in my appeal within 21 days and got myself a barrister and a court date and maybe you should do the same !

This is my first post on here but I will let you all know if I win or lose.
