The thing which is not mentioned is: Did he have permission to be on her land?

What she did was wrong, but he should be charged with trespass if he did land the baloon illegally.

 

Perhaps he didnt have permission to park his balloon on her land,but they're quite unpredictable beasts and it isnt like parking a car at Tescos! She deserved to get the book thrown at her and hopefully never ever has access to guns again.What a nut job.

She shouldn't have done it but a hot air baloon can be devastating with livestock so in her defence it would have been highly irritating having one terrifying her chickens as she could well have had a fair few die as a result. Its one of those things with balloons they rarely have permission to land / crash and rely on bribing the landowner and hoping they are ok about it. In this case she wasn't :yes:

It is interesting in that Hot air ballooners know they are going to be trespassing when they land and rely on a combination of luck and diplomacy to get themselves out of it. Should they just be able to go up and crash wherever they like? I assume compensation can be paid for crop damage etc but a lot try and crash and recover the balloon before the farmer finds out. In this case she was stupid but I can half understand it

All very strange.

 

Why bring a shotgun to a harmless civil incident - I wouldn't even classify it as even an altercation if the other party is apologising and handing over champagne and brandy.

 

Indeed, why bring a loaded shotgun.......

 

I reckon the police want to be checking her greenhouses and giving her farm the once over with some xray equipment :balloon:

No point in threatening someone with it if it isn't loaded. The crime is the same regardless, but if it turns out they have something to threaten back with...

I don't know we had 3 separate balloons land on our field next to our house a few years ago all by the same company before harvest and our compensation was a bottle of whiskey but no apology for the 4x4s driving to pick up the balloon. I fail to see what gives them the right to land where they please and wonder how they would like it if i tried to land a hot air balloon in their back garden :blink: :huh:

Still, would you shove a shooter in their face and press for a quick fix of farmer's justice? I suppose back in the old days you could just lock them up until solstice and then just pop those pesky ballooners into the wicker man...... indeed, those wicker baskets must have come in handy.

Certainly a case of over reaction from granny, and completely unnecessary, as was the ruling on the poor old girl, just take her gun away and never renew her ticket. 18 months? Ridiculous.

 

Should I have been the landowner and lost any livestock, or was unhappy about the 4x4's driving over my property, then I think the best course of action would be to claim on the Balloon companies insurance would it not?

 

Only of course if I was unable to negotiate a free Balloon ride first, for my mates my family and myself.
