i think you will find your friend should not have taken a beating and could press charges for GBH weather if he was poaching or not armd tresspass is down to the police to take action not keepers or land owner .what is it the police say you should of reported it us first . farmer martin rings a bell

come on this is the interweb we only know half the story, you don't know if he threatened the blokes, had been caught numerous times or indeed started on them. It could get messy legally its happened near me keeper got in a bust up with ****** got the upper hand and got reported and was very close to loosing FAC If you suffer regular poaching at night you can understand people getting upset about it. Its not right to give him that much of a beating but a bit of one is fine in my book.

One man, who had a gun. What would you suggest? Queensbury rules? Turn about? Phone a friend? :hmm:

 

Lets not blow things out of proportion , it was a air rifle hardly makes him raoul moat does it ?

If he had a rifle they should not have approached him and if some one was being threatening towards you in the dark where you could not easily i.d him or his weapon i doubt most of us on here would have started a tussle with him :hmm:

Now lets see if ( and we only have the hearsay ) they did indeed cause fractures of his limbs , that takes a fair old amount of force especially against a struggling opponent .

From experience i know that usually when compound fractures and breaks occur in a confrontation especially multiples they are usually the result of some one being struck by a object of some mass .

 

Sounds like a pasting with a bat to me , brute thuggery and no i don't condone poaching but violence to prove a point i detest .

I have a feeling that if he tried to press charges for assault and theft they would be in the strong position. After all he was on there land, with a gun and no permission and im sure they could say they were threatened or at least felt it upon confronting and armed trespasser and so its self defence and i bet they would win because as it would be one person's word against the others 2s and one is someone committing armed trespass would probably be viewed as an unsavoury character and may not be trusted. Just my view on it.........

I'm blowing things out of proportion?! At no point did the O.P. mention anything about broken limbs or this guy putting up a struggle. All he said that this guy took a "right beating". He did however have a gun, all be it an air rifle.

many a time i lamped land with the lurchers that i hadnt permission to be on but i can assure you if i had of got left in hospital then the lads who did it would of had the same treatment , yes i have been nabbed a few times by different farmers and they have told me to clear off and not come back which is fair enough and they got no grief from me i left their land but if they want grief they would get grief

thats exactly what we're up against dog men stealing which is what you're doing and expecting no repercussions. Have to say most people talk the talk but if they've had a decent lesson few go back for more.

I think it interesting that the land owner has the right to confiscate the mans rifle?

The land owner does not have the right to confiscate a rifle as the police informed me one day when i took one and handed it in at the police station.

Charge both with the relevant offences...two wrongs don't make a right :good:

So what is the worst offence then? Poaching or 2 men kicking the ##### out of one man?

I reckon the 2 causing GBH would come out worse off, no matter what mitigation they try to put forward!

with out all the facts it's hard to say.

 

the bloke was in the wrong in the first place and could've got a kicking for just being there.he could also be the one who started being confrontational and came off worse :good:

Actually Armed Trespass would be the worst offence then, as it is a firearms offence and if applied properly carries a mandatory 5 year sentence (for non certificate holders) and 10 years if you have an FAC. Doesn't seem to work that way in practice though.

farmers my way get more stole/grief from shooters than they do from dogmen and lampers driving round back roads shooting into fields that they have no right to and leaving dead foxes and also badgers laying in the fields before driving off

How about another factor bloke out walking a public footpath at night two farmer boys comes across him thinks he is poaching beat seven bells out of them .

 

They claim he had a air rifle which both parties claim is not there as its a air rifle as a rule of thumb no traceabilty so with paw prints all over the rifle of both parties now who would belive who.

 

If I was the said bloke I would just say the above and the farmer boys would be in the poo

 

I dont say poaching is right but they should have called police not matter what the situ FACT.
