Speeding fine

I haven't had one of these 'notice of intended prosecution' for years now.........was caught doing 43 in a 30 zone recently so that's all changed now :good: . I've had a look at their website and it states that on return of the completed form I should recieve a 'conditional offer of a fxed penalty'. Any ideas on whether that's the case or is it likely to be a bit heavy?

 

Please, no finger wagging....I feel aggrevated enough already!

Hi,

 

Ive been told a 60 quid penalty comes with speeding fines aswel as the points, also I have been told that when paying the 60 quid send 60 pound and a penny or something stupid like that. apparently they are not allowed to take the money over 60 quid so they have to refund you. I was told this its a long process and when this happens most of the time its more hassle to give you the money back for you to send the money again. I do not know if its true but i suppose its worth a go

Firstly did you do it? I have had 2 incidents recently where someone with my plates but a different car has caused me to get sent one of those horrible letters.

 

If it was definitely you, you have two choices. Take the 3 points and the small fine, or try and get away with it.

or £60 fine and 3 points, for being honest and admitting the speeding ; let me think for a minute.

 

The advice recieved before is correct £60 fine and three points ,if you accept the conditional offer.

 

If however it was not you ask for photograhic proof of the offence and exercise your right to defend yourself in court.

Of course they can take more than £60,how else do people pay £80 disorder tickets or £200 No car insurance tickets.

 

If you send 1p over the fine they will just refund the difference.

 

Sounds to me you are a man and will take it on the chin.

My brother's girlfriend was caught and was offered driver rehab (an American idea I have no doubt) where she has to attend a 4 hour course and she gets no points as a result.

 

 

Or another great American idea is where certain counties will forego points on your licence if you pay an extra 50% on the fine......

There is a way of throwing a spanner in the works and maybe getting them to make a mistake, drop it or let it time out. Basically you have to submit the drivers details within 28 days or you will be prosectured under section 172 of the road traffic act. The trick is to give them the info to satisfy this requirement but in a format that is inadmissible as evidence in court so that they can't PROVE it is you that was speeding. A few years ago a judge surprised everyone by saying that traffic offences were subject to the Police & Criminal evidence act which says that unless you are giving a statement under caution you can ask for the statement not to be used in evidence. So, you write a letter saying that you are giving the details of the driver on the condition that as you have not been cautioned the info is not used in court. Sotimes they then try to do you under S172(failure to supply details) but a welsh doctor called jones had his conviction for this thrown out on appeal as he had given them the info in teh above letter and the the judge said this satisfied S172 of the Road traffic act.

I did the pace statement in Sept for an offence and had a conditional offer of fixed penalty in Nov. I ignored it and haven't heard anything yet (touch wood). They have to summons you within 6 months. It isn't a get out of jail free card as different forces have different interpretations of the various judgements but it is definitely worth a try. Worst case you get summonsed, plead guilty by post and get costs of £35 on top of the £60.

I'd just like to point out that I'm not a habitual speeder and have a very high respect for the law which is why I don't think anyone is guilty until it is PROVEN (which most speed cameras don't do) and we all have the right not to incriminate ourselves. Give up these principles and we're on the slippery slope.

Well that caused a stir ;) , I was more worried about maybe getting 6 points and £100's in fines. General idea seems to be 3 points and £60 and I can live with that. Strange thing is I have viewed my piccie on line,(that was a new one on me), and my car is going away from the speed camera, it was a mobile unit and as such I thought they only asked you to smile full frontal?!

 

'tis a ****** though as just ahead of where I was snapped you can actually see the national speed limit sign..........it's fairly natural to increase your speed there, or thereabouts as you're out of the village...high wall one side and open fields the other, no danger and easy to get miffed about it, where he was hid I don't know :good:

If its your first then take the points and the fine , if your heading towards 12 points , you have to look at your options : Are you married / girlfriend , someone who will take the blame , try and drag the process out by filling the form in wrong. Speed cameras are a total pain in the *** ,so good luck.

Mobile gatso, works on doppler radar as you pass it, there would have been calibration marks on the road.

 

'tis a ****** though as just ahead of where I was snapped you can actually see the national speed limit sign..........it's fairly natural to increase your speed there, or thereabouts as you're out of the village...high wall one side and open fields the other, no danger and easy to get miffed about it, where he was hid I don't know :good:

 

That's sadly exactly why they set up there, nothing at all to do with safety, simply a revenue earner.

 

Get a gps and speed camera warning doofer, tomtom one £160 from halfords at the moment does the job nicely - worth it compared to any more points ;)

I can't moan too much, travel approx 25-30,000 miles a year so it had to happen some time soon and I don't have time to stick to the limits too often, if it's only 3 points/fine i'll be ok with that, it should be 9 points now anyhow, (cough)........does Tom Tom detect these mobile gatso's?, i'll have to sign up if so!

Two things:

Its a lot easier/less stressful to fight the first three points than the last three

Purjury is taken more seriously than speeding. People have gone to jail for lying about who was driving.

 

There's a judgement pending from the Europen Courts on the PACE method,(due very soon I think, the hearing was in November) If it is upheld then anyone who has used the Pace letter will be acquitted and have their points removed and fines returned. Don't hold your breath though.

A friend of mine was caught speeding on his way home from Scotland after a salmon fishing holiday. He replied to the letter that he was sharing the driving with his traveling companion and they had no recollection who was driving at the time of the offence and the photo supplied was of no use.

His answer was that he had no problem with paying the fine but could he share the points, 1 1/2 each, with the co driver.

The police took no further action.

if you look about on the net there at web pages and posts from people that are ways of gettin off the hook! and i found a book back along that cost about £5 and it was full of ways to get off the hook! so my mate took pics of the best bits 4 me, but unfortunatly the police have taken his computer! not for copyright infringment i am hastant to add.

So when you kill someone or your self that will be OK with those that are left to pick up the pieces,including the people that have to,literally,pick up the pieces :good:

No I drive sensibly but aren't stupid enough to say I stick religously to the speed limits..........do you get so upset at people driving at 75mph on the motorway when it's safe to do so, if you read my post relating to the conditions you'd plainly see there was a clear road, a good view and a white and black circular sign just yards away.........my lud. You are aware about driving safely and still exeedng the speed limits i'm sure.
