But you are allowed to use a gun or other deadly force to defend yourself.

Even so, most people would see this as a man who had exceeded all reasonable or unreasonable morality, he is on trial after all.

Is there any way you would shoot your girlfriend through a locked door, if you had been in bed with her? Having no idea where she was but knowing we all go to the loo? Also, why lock the door if you are with a bloke who has fathered your child, come on !

SA doesnt stretch credibility that far I suggest.

Shooting your defenceless girlfriend is hardly defending yourself. You are allowed to use deadly force to defend yourself in the UK as well.

I don't disagree - but that is what the court needs to determine. His argument is he thought it was a burglar.

I was merely trying to show how attitudes and reactions to crime in SA are different to the UK. Using deadly force here in the UK is theoretically allowed, but not condoned nor explicitly defined in law - you can be sure you will be treated as a criminal if you do.

Had a Skype chat with a friend in SA this evening. His opinion is as mine is - basically Pistorius is guilty - but not of a premeditated murder. This burglar story is bull. He lost his cool, shot into the bathroom knowing she was there but did not intend to kill her, rather just to scare the **** out of her. So IMHO guilty culpable homicide. Doesn't let him off though - still a jail sentence, but nothing like murder. The prosecution will have to determine if he killed intentionally for murder, or negligently for culpable homicide. We'll have to see what other evidence comes up, and how it is argued in court though.

Apparently he was massively jealous of her friendship with her Ex and rugby player Francois Hougaard.

i think hes guilty, he also had a really bad temper and they often had massive arguments...but that doesnt mean hes guilty tho.

but in reality i think he will get away with it....theres a 6 series program on youtube called special task force 1 which is about the crimes that happen in south africa and how the police deal with them..full on shootouts, bank jobs, kidnapping... the lot, well worth a watch.

I watched a tv program that showed the bullet holes were at the top of the door pointing down towards the sink and toilet, they said that would be difficult to do having no legs, so they think he put his prosthetic limbs on first ..... Raising the question about why he said he panicked rolled out of bed and blind fired.

to be honest if i thought i was being burgled and had to get a gun the 1st thing i would do is find where in the house my gf was so i could protect her/ give her a gun. not shoot threw the bathroom door at an unknown target when not knowing where my gf was, he's either insane or guilty has to be

That's what we would like to think we would do - but when it comes to the crunch, in a very stressful situation, anything could happen - including common sense going out the door.

To put it in perspective - South Africa has a population of roughly 50m - and about 15000 muders per year (it has come down - was close to 20000 at one point). UK has a population of 65m - and far less than 1000 murders a year. South Africa is the rape capital of the world too. Hell, even the president, Jacob Zuma, was on trial for rape. It is almost a national passtime.

Not saying he's innocent (I think he's guilty), but in a country where it is not uncommon for an intruder to either murder, torture, or rape you or your family, shoot first, ask questions later is a common response. People get very jittery about security and crime. Some may think i'm exaggerating - but I lived there for 12 years. I personally know people who have gone through this kind of stuff.

He shouldn't be let loose with a blunt spoon never mind a gun.

Negligent discharge in a restraunt and a girlfriends car. Nut job.

I think he has chased her when arguing/fighting and she has shut herself in the bathroom, then he has shot her through the door.

Figgy

Having been to SA and know a fair few people down there, they will most certainly shoot first and ask questions later. Yes they all live within high wired enclosures with armed guards but that doesnt stop bad **** happening.

One chap had his dog killed followed by them trying to kill his wife (kill first then rob the place), he shot two of them before the others scarpered.

Its a different world to mollycoddled UK.
