You are not getting it he could of possibly got away with self defence if he had not shot them whan they were running away and no longer a threat it then went from defence to vengeance, there would be the matter of using an illegally obtained shotgun. The same applies if what you posted above happened, if they were in your house and you felt your family or your life was at risk then you could use lethal force but if they ran outside your house and you shot them through the window that would be unreasonable force.

Read my post again, read what I said not what you think I said.I said the law should be CHANGED so that if you catch somebody robbing you property you can use lethal force, so if they break into your property or you catch them breaking into your car you can stop them any way you want. if they die tough titty you then should not even be arrested. So what happens when someone stumbles in a house by accident because there drunk/mentally impaired etc unlikey I know but it does happen

Having read through these posts I'm not sure the case is that well understood, either prior, at the time or since. The number of previous incidents, the inability of the police to effectively deal with it, the feeling of helplessness, understanding of his tipping point and the number of post 'at it again' incidents where nothing occurred.

 

Here's another shooting case, this was after the law became more sympathetic to property protection following the Martin case, as a neighbour said "Given they've had previous break-ins, he was outnumbered and wanted to protect his wife and his property." HERE.

 

Some might be aware of this case, of the mother and disabled daughter, HERE

It's not dissimilar; continual harassment and mental strain, the feeling of helplessness, not dealt with by the police, their tipping point and then suicide & 'murder'.

 

Thankfully my tipping point has never been tested.

the whole tony martin thing has been done over and over again.

some are aware of the full story, others are not.

just a shame that those that don't know the whole story still feel the need to comment (that's not aimed at anyone in particular...)

 

the guy was pushed to breaking point, and snapped. something that could happen to anyone and I whole heartedly think that anyone could have reacted the same way.

it doesn't, however, excuse him shooting someone in the back or for having an illegally held shotgun.

 

with regards to using a gun on an intruder, my view is this...

 

if I genuinely felt that mine or my wifes life was in danger, I wouldn't hesitate.

BUT,

the devil lies within the detail in that statement, as that is what you would be judged upon.

I certainly wouldn't go waving around a shotgun for someone breaking in to my car.

The police force seems a lot busier catching Facebook and Twitter offenders than trying to deal with old style crims. They have absolutely no interest at all in getting on patrols, answering to calls for checking stuff out in the street, and even now don't even bother with burglaries.

 

I picked some shaddy blokes angle grinding car bits on a back road near my house a few months back, at night, called the police, and nobody ever came.

 

On the other hand a colleague had a 3 police cars bust in his house at 4am one day because his wife had mentioned jokingly that she'd have to force feed their little boy in case he doesn't eat his vegs on facebook. True story. They terrorised his other kid by serial asking him question as to wether he was abused or not. At 4am.

 

Of course, thats a LOT easier to catch the baddies when they are tax paying and you can do facebook all day to catch them... instead of getting out

i feel for tm,,,he,s a victim of circumstance,yesterday while on my way home from my ladies house got a call on my moby from my neighbour 10am that my house had been burgled,4 scrotes in hoodies were seen scrambling over my back gate,,,guess what i floured it home,,to my relief they hadn,t gained entry but they shattered a double glazed unit which i had to get fixed,and while guns are always locked up i do have other means of self defence.and would crack skulls if needed.

digger and geordieh - I suspect your combined IQs would struggle to make double figures.

 

digger - there is no answer to people who think someone tinkering with your car merits death. It is not a rational opinion. It is sick and I think the poster should seek medical help. That is my opinion.

 

If he has an SGC - surrender it. Tell his FEO his opinion and the decision will be taken out of his hands.

I agree the system is broken however it's the politicians who have made the system I'm sure the average copper on the street would love to catch the burglars murders rapists ect rather than stuck in a office doing paperwork.
