Mungler Posted June 13, 2007 Author Report Share Posted June 13, 2007 It was a 70 mph bit but the ****** is I understand they can give 6 points for this speed and anything above 90 mph they have a discretion to ban (at worst it would be 1 week but that would be enough to knacker the insurance). We don't do any criminal work but one of my partner's wives is a solicitor clerk at the local magistrates court - she is looking up the sentancing guidelines as I type. 3 points and a fine I can live with - it's just an extension of road tax these days. I'd imagine you'd be going to court for this one, plead that you need the car for your job and you won't loose it, good weather and traffic conditions will count in your favour. Axe Posted June 13, 2007 Report Share Posted June 13, 2007 Mungler, I was caght on the M23 Januray last year, the gun showed 100.1 MPH. Anything over 100 MPH is immediately dealt with in court. Right at the last minute I had to tender a letter without attending, due to work commitments. I was given a £300 fine and 5 penalty points. As far as i'm concerned, I got off lightly! I am liking the look of: 1. 95mph 70mph limit, 28 yr old male, Laser trap, 3 points, £60 fine, car Volvo S60 2. 16mph to 25mph over the posted limit £45-£100 £30 4 points 3. Limit = 70 mph. Axe, I went to court with the Financial Director of the company I worked for and a Brief, and told the court I would loose my job if I lost my licence. Brentwood Magistrates Court some weeks later, Solicitor stands up and says, "Cranfield employs 150+ people, has a factory in Kent, one in Manchester and depots in Glasgow and Dundee, he needs his car for business and peoples jobs could be at stake". The magistrate replied, "if he is that important, he can get someone to drive him around". £350 fine, 28 days ban (therefore no penalty points - slight bonus). It doesn't always happen as an empty motorway is a real temptation but I cannot afford to go paying out large amounts of money on fines, and the fact that they are getting better at catching you means that I try harder to keep to the limits. Pleaded with the officer (I was a hard up student at the time) and he let me off with 3 points and £40. Now thats what I would call - getting away with murder!!!!!! It is not speed that kills it is lack of concentration and inappropriate speed : 95 mph outside a school is inappropriate whereas 95 mph on a clear dry motorway is the norm for most M-way fast lanes. Whatever fine or points I get it will not alter my driving. There was an article in the Times a couple of days ago which confirmed that the insurance industry will not load a driver's policy for anything less than 6 points because with the proliferation of cameras means more people than ever are getting nabbed and ticketed. It is a matter of when not if for everyone. I have a mate who is a driving do gooder - tutting when he heard about people getting points and his always professing "I just don't speed" (said as a factual statement). If I had a £1 for everytime I heard him say that, I would have plenty to cover whatever fine is levied. And oh yes, when he got a speeding ticket for 41 mph in a 30 mph and 3 points I laughed the biggest laugh. Funnily enough he is silent on the subject of speeding now. As has been said 30 mph is the legal speed limit for residential areas and 70 mph for motorways. Anyone who drives above 30 mph / 70 mph is breaking the law. Got the option of 3 points and a fine or pay the £60 fine and watch and attend a speed matters course for 1 day. I picked the latter! I reckon for 96 in a 70 - either 3 points and heavyish fine so £300 or 6 points and low fine £60. Best of luck with it mate, it happens to us all.
