Anyway was coming along this dark country road about 45-50mph when all of a sudden this black cow appeared in front of me, I swerved but I hit the cow. Drove up the road and surveyed the damage (smashed wing mirror, badly dented bonnet and a couple of dents on the door where the wing mirror had hit). So stopped another car and we found out that a gate was open so we managed to get the cow back into the field. I then found out who owned the field and visited their house. The coversation went something like this: Me: I just put one of your cattle back into your field, but it hit my car first of all (showed him the damage) Farmer: how is the cow? If it needs vetinary treatment it will be at your expense. Me: how would it be at my expense when your gate was open, the cow shouldn't be on the road. Farmer: The cow has every right to be on the road, what would have happened had it been a child? Me: The child would preferably had high vis on and it wouldn't have been on the middle of the road. Listen I'll just phone the police and we will see who is in the wrong. So I got onto the police and they rightly said the farmer is responsible for his livestock and that if we don't come to an amicable solution the police will go to his house and prosecute. I didn't want it to come to this; I just want the farmer to pay for the damage that his cow caused. I am just so glad I saw the cow in time and managed to avoid hitting it properly, if I had of hit it properly god only knows where I would be now. Farmers can be prosecuted for letting livestock stray like this so I suggest you stick to your guns. The farmer perhaps feels caught on the "horns" of a dilemma...
