is it possible to sell guns if police has seized them?

If you are a BASC member, I would give their firearms department a ring. You will get a load of conflicting advice on here from well meaning members; but none of it will cut much ice with the Police. You need genuine legal advice; as just sticking them on your mates ticket wont gaurantee they get handed over to him.

im speaking to a solicitor in morning who is an expert in firearm law so should get some answers

hi is it possible to sell my guns to my mate after they have been seized? im on appealing there decision not to give them back?

You must get good legal advice from a firm that are used to "taking on" police.

Police think they can do anything and they can untill they are stopped. They will drag it out as long as possible.

I have been in touch with a lady called laura sansbury shes really good from what I have read shes ringing me back in morning

If they have been revoked then I would give it at least 2 years even if u have no charge ! They went to the bother of taking them off u so they have had their reasons! Let the dust settle , try go with friends where possible who do have a licence and just lay off the shooting until u see some light ! Time is a healer in this case I'm afraid !

Unless u are still in the 2 week clause of them being revoked then appeal but if that's past then forget it

they only told me on Thursday so well with in my 2 weeks

its not revoked unless you have it in writing.... Firearms act is very clear on this, unfortunately the police can keep you in limbo by not revoking, once revoked you can appeal, having not yet been revoked you are left in limbo until your expiry or revocation comes through. I am sure the lawyer will take you through everything tomorrow.

i had a smiler thing mate i done the appeal went to court and won my case and i never even spoke to anyone for legal advice all i can recommend is to get as much letters from friends colleges character references saying how long they know you what type of person your are like any help you have given them the judge looked through every single one of mines and said its exactly what he like to see

I can see no reason for you not to be handed back your guns now after what you have said happened.is this your only encounter with the police as past history/record will obviously have a bearing on any appeal.if this is all a dreadful mistake then I would think a strong letter from a solicitor may well be enough to sort this for you.if on the other hand there is any past history of any kind of violence then that will be a different matter.but good luck with your case.

FEO told me they do confiscate firearms, even if charges have been dropped. Example he gave me is a wife/partner of a certificate holder who phoned the police about domestic violence, then later dropped the charges each time. After the 4th time of this happening, they took his guns off him.

 

As has been said - is this the only encounter you have had with the police?

I have done this for people and recommend you give it a try.

 

Write to the FEO in your area, and inform him/her that you have arranged for a friend (best from the same FEO area) to take charge and care of your Guns. Ask to arrange a convenient time for collection and await response.

 

You do not have to sell them to your friend, a RFD will cost you, and then you will have to pay storage at the RFD.
