brett1985 Posted April 25, 2013 Report Share Posted April 25, 2013 nope, not at all. if i am passing traffic thats on the inside lane and i'm doing 70mph then i am perfectly within the law and acting in a safe and responsible manner. the **** behind me flashing his lights and flipping me the bird while biting chunks out of his steering wheel is the one who is in the wrong. brett1985 Posted April 25, 2013 Report Share Posted April 25, 2013 just to clarify, if someone IS going faster than me and i can see them coming up behind, i will generally move over as quickly as possible. but if i happen to be passing vehicles in the inside lane and someone flys up behind me and sits 2 foot off the rear of my car, then i am perfectly willing to make their journey take a little longer... if they have no road manners then why should i move over? Scully Posted April 25, 2013 Report Share Posted April 25, 2013 This has already been through the courts hasn't it?There was a spate of 'tailgating' accidents which even made the National news;in one instance where cars were deliberately swerving in front of wagons they had just passed,and causing the wagon to shunt the car as it slowed to leave the road via the off-ramp,and another bloke who realised,from his office block window,that the same driver seemed to be involved in ALL the tailgating accidents on a roundabout just across from his office! In both cases they were making quite a tidy sum from insurance claims until sussed.In all cases they were braking deliberately to cause the vehicle behind to crash into them,and were prosecuted for doing so. Best just to signal and pullover and allow them to pass. Better to have a tailgater in front of you than ramming into you from behind if you have to brake sharply..... This happened to me a few years ago.... car over took me and the car in front of me (both doing 30 in a 30 zone) yes I was a bit close but could see miles in front, dry conditions anyway, once the car had passed the one on front of me it cut in rather sharply causing one in front of me to STOP, he neednt have stopped at all really...... Anyhoo.....I couldnt stop in time and clipped the offside rear corner, (im in a 44 ton artic so clipped is a bit of a shunt) I stopped, gets out, and before I sad anything the driver was going on about this car that cut him him up forcing him to stop, I said well you didnt really have to stop he wasnt going to hit you..... So after I ask if everyone is ok (4 people in total) all reply yes, no problems, I mention the police, guy in the back says he has rang them and they said seeing as nobody is hurt just to sort it out between us. Now bear in mind this is the Friday before Xmas at 5 in the afternoon in Bolton, so its a tad busy, I rings the bakery im heading to to send a truck out as my passenger footstep had been pushed back into my wheel and I couldnt move. They were no more than 5 miles away, took them nearly an hour to get to me Chummy in his MERC, is from London, so is a stranger there too as were all of them so they say. They have a recovery truck there in 10 minutes and after swapping details are away...(Rush hour, Friday before Xmas, strange town) Anyhoo, next day my transport manager tell me they have contacted their insurance AND solicitor who has contacted our company and 4 whiplash claims go in plus the Merc is a write off Tell him the whole story about time/location/circumstances and he informs our insurers who send out an investigator... Upshot was.....the solicitor they used was under investigation for 6 other very similar cases, They didnt get a penny, nothing for the car, dont know if they were prosecuted or not Not being racist here but all were Asian Its rife down Bolton/Manchester area Edited April 25, 2013 by shaun4860 Quote Link to comment Share on other sites More sharing options...

Entry to "CLOC" is free and there are no conditions for entry. "CLOC" Central Lane Owners Club", strap line = yes we do own the road. Livefast123 Posted April 25, 2013 Report Share Posted April 25, 2013 (edited) Quite simply, if it can be established you braked delibrately with no reason and caused an accident then you would be looking at prosecution for due care or dangerous driving. You would be suprised how many vehicles have cctv fitted these days and that includes private cars, there is also the myriad of council cctv systems and the numerous witnesses that you failed to see in your desire to sort the tailgater out. If you have a tailgater behind you, don't play childish games and sink to their level. Drive normally and let them get past when they see fit. It's a lot safer for all of us. Insurance companies will always settle for the cheapest settlement for them, not what is best for their customer. If you have no witnesses even in a 'non fault' claim then unfortunatly you are probably going to be done a misjustice. neil3728 Posted April 25, 2013 Report Share Posted April 25, 2013 I love people who tailgate me when i'm in my disco 1 (Heavy Duty rear bumber and tow bar, not sure i'd feel them hit me anyway). Happens all the time near me. It usually start when people try to cut in at a roundabout, when they realise I won't move over the get real close behind me. flash their lights and just act like a PITA as they are driving a flashy car i should move over.
