Insurance claim

Need some advice, pulled into a gap between 2 parked cars to give way to oncoming traffic. Whilst stopped, the car parked behind me reversed without looking and wedged herself between me and the kerb. Mine is pretty much superficial paint damage but her bumper was ripped off. We got out and she instantly admitted liability and apologised, with a strong Lithuanian accent. Since then her boyfriend has rung and claimed that she doesn't speak English so couldn't have said it, and is pressing me to pay for the damage to her car. He is claiming that I hit her as I pulled in, so unfortunately if it goes through the insurance it is just my word against his/hers. I don't particularly want to lose 10yrs no claims, but equally it galls me to pay for something that wasn't my fault!

Find some witnesses!

Without independent witnesss it's knock for knock I'm afraid. From experience.

A cousin, who used to be an insurance claim investigator, once told me that whether it's your fault or not; if you make a claim you will lose your no claims.

He was right; again from experience.

You don't loose the full 10yrs,speak with your insurance. Edited by Davyo

As mentioned, go back and look for cctv cameras, shop front, private house, street lamp what ever! If the incident was caught on camera offer the cctv owner a few pints for the footage as long as it's time and date stamped.

 

If it goes knock for knock and your NCD is not protected! You revert to 3 years NCD, and start again from there. This is the exact reason I installed a dash cam. I had a bint plough into the back of my car on a roundabout exit! Long and short, no wittiness so regardless of her hitting me from behind I lost over 20 years NCD and went back to 3. Total cost of the claim for her damages? £100 and I kid you not! She tried it on as the front of her Clio was destroyed. I had an inkling something was fishy. I phoned the insurers straight away with a pic of her car, she hit me with the front off side of her motor onto the rear near side of mine leaving a scratch on my bumper that polished out! Both her headlights were smashed, the bumper was in around four bits, the wings cracked and funnily the majority of damage was her near side front? That's what made me suspicious. Anyway, as I thought a week or so later the insurers rang to make me aware a claim had been lodged! So again I informed them of my suspicion. Then upon questioning her she admitted the majority of damage was from her hitting her garden wall that morning! Don't ask me HOW she still wangled the £100 for the O/S headlight? but it screwed me over big time. I was livid and wanted to go pay her a visit and ask what the hell she was playing at.

 

So for £100 she screwed my NCD and her own? Even though it was her fault!

 

Seriously though! Invest in a decent quality dash cam to cover front and rear! Oh! And turn OFF the audio ;)

 

If you flip verbally durin or pre bump! It can be used against you so be careful. Also if you apologise (not meaning to admit liability) it is still an admission of guilt in their eyes. I turn mine off. Time and date stamped vid is usually admissible in court. And in some cases if shown to the other party, can help to settle out of court.

Did you not get protected n c b . I find it is worth it .does not cost much to put on

Unfortunately, it protects your NCD in name only. You still have to declare your accident (regardless of fault) for upto five years! Some four. So for those years you will STILL see an increase in premium until the allotted time passes! While if your talking 20+ years like mine was it may have been worth it after the 4 years, if your just starting out, or have less than the 4 years. I wouldn't bother. It's like the speed awareness course, the point was to allow you to sit the course and avoid the points, "and thus an increase in premium" then the insurance companies made it compulsory to inform them! Yes no points! But again for upto five years you pay an increased premium!

 

They will have you over a barrel no matter what clever wording is used to make you feel teflon coated.

Your bang on mate,I only ever once protected my no claims.Insurance still increased by £90 following year.I found I could get it cheaper elsewhere even though the insurance company said you can't take your no claims with you.

I have protected ncb .shop around every year .and infact mine comes down with who ever is the best deal

Never gone up in 5yr . My premium is only £100 more than it was 40 yr

I WAS paying approx £360 fully comp on a 406HDI until Sheila's Kranky wheels ploughed into the back of it. It then went to over £700 with the same company! I managed to get £550 elsewhere. Last year I was paying £150 ish fully comp on a 1997 Astra 1.4 before buying a laguna 2.0 dynamique. Got the fright of my life when the fully comp went up to £465 a year as it's a group 21 apparently. Looking to find a cheap kangoo 1.2 at the mo, dad has to rap in driving. I need a small MPV big enough to take two mobility scooters. The Kangoo fits the bill nicely if I make some racking for the boot to stow one over another.
