So you had the rifle in your front room, pointing it out of the open front door and onto what?

 

The house opposite? The green outside your house?

 

Then you removed the scope and went to the front door without the rifle, and that's when you were 'spotted'?

 

Thats it spot on the laser was pointed at a wall in the corner of the green

had a knock on my door one day after plinking on my garden with th air rifle. one of the neighbours told them i was shooting at there house when i was shooting at the back stop in the other direction :hmm: :blink: they came inspected the backstop and air rifle told me that a silencer that was on it is illegal :blink: and left :good:

Surely though, you must have realised that if you could see out, anyone else could see in?

 

Even standing/sitting in your front room and pointing the rifle outside is going to cause alarm to anyone watching/passing.

 

I don't want to sound harsh, you seem a decent bloke and I really hope you get your guns back, but what on earth possessed you to do such a stupid thing? Especially when you know your neighbours are anti-police and nutters, I bet they're lapping it up.

My be worth contacting your Union also as your PSD will probably get involved. I'm fairly certain that a firearm doesn't have to be disharged before an offence is commited. Sec16A of the firearms act is possesion of a firearm/imitation firearm with intent to cause fear of violence. Just pointing a gun (and I would suspect anything which could be mistaken as a gun)would count as commiting this offence.

Because someone has called the police a breach of the peace has occurred, however when you went back inside it ceased. Then there's all the harrassment / alarm or distress public order offences. If they'd wanted to they could just have seized your guns under Sect 19 PACE as evidence of an offence, no warrant needed.

 

Moving from rural Wales to a new build in England has ruined my shooting......I wouldn't even think about taking a gun outside / anywhere near a window. It's sad but true but there's far too many people who will call the police if they saw a kid with a cap gun!

 

I've resorted to the pistol crossbow in the back garden, what they can't hear won't bring them to the window :unsure:

No as per BASC firearms department unless they have a warrent or you have discharged the weapon or commiting a breech of the peace then they can not take your guns.

I asked for a reciept and was told they don't give one The Rifle wwas Never in the public eye at the start i opened the front door and i was in my front room which has no direct line of site to any windows it was after i removed the scope i went to towards the door it was at this point i believe i was seen. The lazer moving around had already drown the attention of the person across the green.

 

Under section 19 of pace police can seize any evidence relating to an offence.

They were at your door because they suspected an offence may hae taken place.

Therefore they can seize your guns as they may have been used in the suspected offence.

From what you have said I imagine ou will get them all back very soon.

I sincerely hope it all works out soon and you get your guns back post haste.

 

All I can say is that thank God I live in an area where one can sight in a scope/lamp in ones own garden, walk down the road with a broken shotgun over ones arm and leave it propped up in the bar during lunch.

 

Oh and I forgot to say, shooting branchers from the road. But then common sense prevails in North Devon !!

I would Just like to say thanks for all the positive replys and as soon i havee had my meeting on Thursday i will let you know what was said I have owned up to not thinking first and if the fiddling with the up/down left and right which all work oppesite on the lazer i may not of drawn attention to my self its not there is probley 10 house surround this green and most are on the incapacity benifit and they know how i work for poeple may not like police or police staff but we support you all 365 days a year.

Your best bet at this point it show that you are nothing but regretful, sorry, and harmless. Be polite and quiet, think about what you are going to say and how you are going to say it.

 

Proving that you are nothing but a harmless pleasant chap who made a single stupid mistake is the best defense to keeping your firearms at this point in time.

I would suggest you take in someone from Basc to your interview failing that a specialist soliciter remember at the time of the incident you have already gave them an interview and they may decide to charge you. I hope not but if they are anything like the ones up here you have my sympathy. :good:

Ok I must have missed something as I read this thread quickly on my phone. I read this as sixhills pointed a scope and a laser from his house to a public wall and possibly a house, and the firearm was not pointed from a door or anything.

 

Did I get that wrong?

 

If not, I fail to see what the fuss is about and what he did wrong.

 

A scope is not restricted and neither is a laser sight, viewing public property is also not an offence. Neither action is even a slap-on-the-wrist in my opinion, hence why I think I read this wrong!

But... the member of the public who reported it to the police stated it was a rifle being pointed (not just a scope... otherwise, all the astronomers out there would be screwed!) and that he say sixhills cycle the bolt of the rifle 3 times whilst he was pointing it at him/his house!

No you have not miss understood what you have read (the person that complained is a known drug dealer and told load of ---- and the inspector on duty made a call weather it be right or wrong THE GOOD NEWS IS I HAVE BEEN CLEARED OF ANY CHARGES :good::good:
