team tractor Posted November 2, 2022 Report Share Posted November 2, 2022 Long story short …. My ex wife has claimed benefits in my name and I wasn’t aware. The first I knew about it was when I had a fine drop through my door. This is when we were together and over 5 years . I’ve tried writing letters , phone calls , I’ve begged them to take it to court but apparently as we were owed it I can’t do anything. now the silly bit . The fine is because I never informed them we had split up I never knew we were claiming until I managed to get in my house after the split 3 months later . please can anyone help ? ditchman Posted November 2, 2022 Report Share Posted November 2, 2022 my experience with the DWP....is although everything seems to be going wrong..........keep your head ..because the DWP will always get it right in the end....they are sooooo slow...and like a dinosaur............and when youare ready to jump off the bridge a letter will drop on your doormat....and everything will be ok.......... just keep gently bangingon to them.........you will be ok in the end....... i dealt with them on several occasions thought i was bangin my head against a brick wall....and the last time i had to send my wifes death certificate into them 4 bloody times ...before getting things sorted dontgive up Quote Link to comment Share on other sites More sharing options...

bruno22rf Posted November 3, 2022 Report Share Posted November 3, 2022 If you have attempted to inform them of your innocence and you can prove that you were unaware of the claim just let them take you to court, a Judge will get them in order and you can claim expenses for your time. I would also suggest contacting your local MP as well, it's surprising how quickly you get a result once you do this. Although your MP is think is Chris Pincher, I'm not sure what's happening there at the moment. Is it a fine or are they seeking to recover an overpayment? A debt recovery company has no special legal powers to collect a debt, whereas bailiffs, supported by a court order, do. You do not have to let debt recovery companies into your property and they cannot seize goods. Tactically I would Google search the appropriate DWP Minister and send him / her a very short letter (with appropriate DWP file references) to the effect that your wife wrongly claimed benefits in your name: The Department has wrongly concluded that you owe money in respect of that claim and has now appointed a debt recovery company to enforce a debt which has not been independently assessed. Would the Minister please instruct his / her officials to suspend debt rectory action until they have proved their case in Court. This tactic may seem extreme. I have however twice used the Ministers correspondence route successfully: and, from where I once sat in government departmental pecking order I can assure you that heads of department hate receiving Ministers correspondence and will very thoroughly examine your case before replying to their Minister.
