Mungler
oh well, never would have happened if she had provided the sample for the breathalyser - and by the looks of things she never got around to giving them one either Ms Somerville was arrested in July 2008 after being found asleep in her car. She had been detained for failing to provide a sample for a breath test but denied any wrongdoing. The Crown Prosecution Service said the charges were later dropped due to insufficient evidence - bbc link! so there you go, if you want to get off a drunk driving/drunk in charge conviction simply refuse to give a sample to police then get a cop to throw you face first into a floor, then theyll be too busy rushing you to a+e to worry about how hammered you are Being drunk and asleep in your car is not an offence unless you are in control of your car i.e. keys in ignition, intention to move it etc. The give away would be the asleep bit - being asleep not quite the same as being in control or considering going for a drive. Indeed, even if guilty of drunk in charge of a vehicle you can get just 6 points for that and no ban - a very minor RTA offence. However, this is all speculation because she was charged with *nothing* and is not guilty of anything. I would also add that in my experience, if the police do find someone drunk in charge of a car i.e. drunk and in a car which is stationary, they will always hang around for as long as possible to see if the keys get turned and the car starts rolling because that's when it could become drink driving and decent collar. Who on here hasn't been drunk and asleep in a car at some point? And with no intention to drive the vehicle until sober. Indeed, between the ages of 17 and 25 I spent most of my weekends drunk and asleep in a variety of cars. Besides, the point is serving police officers can't do this to people who are drunk, sober, guilty or innocent. Absolute disproportionate use of force and an assault. Court says so, and 6 months inside says so. Glad to see so many people on here supporting a person who is a convicted criminal and guilty of assaulting a 59 year old woman. Very big and brave stuff. Mind you, as a convicted criminal if the officer in question got a taste of his own medicine whilst taken into custody would those agree that as a convicted criminal he got what was coming to him. Oh the delicious irony of it all Edited September 7, 2010 by Mungler

gixer1
There are some people who deserve a slap in life, not by this copper though, and by doing this he entered himself into the "needs a slap" category. I cannot stand bullying, if it's a fair match or both parties are willing Adults then fair enough but not a man slapping around a 5' woman! Oh the delicious irony of it all from what i was told simply being in the car and having your keys in your possession is enough to get done, i remember dealing with a guy once who'd been done for it because he was sleeping in the back seat of his car while drunk

Being asleep appears to be a good starting point Defences Any person who is accused of being in charge of a motor vehicle while unfit through drink or drugs will have a defence to the charge if he can show that at the time of the offence there was no likelihood of his driving the motor vehicle. The court will look at various factors to decide whether this was the case or not, including whether the keys were in the ignition, whether the car was running etc. These do not conclusively prove that the person was in charge of the vehicle for the purposes of the law, because the intention to drive must be proven according to the facts. paulf
How can anyone justify the guy throwing her to the floor like a rag doll.... utterly disproportionate unnecessary and wrong. There is using force to restrain someone and then there is using dissproportionate force.

shaun4860
really? http://blogs.telegraph.co.uk/finance/ianmc...to-boost-yours/ what i didnt know until recently was that all public service pensions come out of the normal pot of money that pays all the bills i thought the pension money paid in went into a pension pot, but it just gets spent like normal taxes do, so we all pay the gold plated final salary pensions paid out.... shaun

If anyone else did that to her, say in the street, she would be entitled to compensation from CICA, so why shouldn't she get it here? njc110381
I watched the video when this first came out and to be fair to the copper she wasn't exactly helping herself was she?! In the waiting room you could see him trying to escort her to a cell so she folded to the floor just to be a pain in the ***. So the copper drags her - fair enough because she's only small. Then they get to the cell and she's still not cooperating so he just chucks her in. Maybe a bit heavy handed but it didn't look like he'd pushed her with the intent of her falling flat on her face. She just landed badly. Perhaps he was heavy handed, but at the end of the day the silly old bint didn't exactly help herself did she? She caused trouble and got hurt. The way I see it if she'd have just walked to her cell it would all have been sorted and she would have been fine. It's not all the coppers fault.
