My avatar is designed by me from a photo that I took which is under copyright to me. I have recently noticed that someone on another forum is using my avatar without my permission. I suspect that he has just copied and pasted it from one of my posts as this is what I did with his to check that it was in fact my avatar. I am not overly worried about it and I don't want to make a big thing out of it but surely it would have been plain and simple good manners to have asked me for permission to use it first. I have sent him a PM politelty asking where he got it from and if he obtained permission but I am still waiting for a reply! Any thoughts on the matter Guys? As I have said I am not overly worried about it and was just asking out of interest as I thought that as it is not available for "general use" and should not be available on any of these "free avatar" sites anywhere it would have been polite to contact the used that it was taken from to ask first. As my previous post says I am not overly bothered, I would have though that it might have been good manners to ask first as it is so individual! Imperfection Posted February 11, 2012 Report Share Posted February 11, 2012 I dont think anything could legally be copyrighted on the net Frenchie and once an image has been copied many times by other people you would find it hard to prove ownership anyway.My Zippy avatar for example started off as a full sized image which i found on the web and just resized it to suit,but ultimately someone at some point created the picture. sodit Posted February 11, 2012 Report Share Posted February 11, 2012 If copied from your Avatar on PW I would have thought it would be simple good manners to ask (cos to be brutally honest he or she could still just copy it if they wanted) but unfortunately good manners,politeness and concern for other people seems to be hard to find these days. And before anybody starts to rant (also read first line of signature) I know there are good people out there, just seems to be less of them than there was! Sorry Catweazle I don't think that I am being "precious", after all I have clearly stated TWICE that I am not overly worried (Even though if anyone did that with some copyrighted work or photos they could find themselves on extremely hot water with the owners of the copyright) so I don't quite understand what you are getting at. Surely there is a bit of a difference between (As you have just put it) "being precious" and plain and simple good manners! As a footnote - I should in fact add that if someone wants to use my work or photos then I could in fact take it as a compliment to both me and my work, but I would appreciate them asking (If practical) first! However, I am a member of the PRS and they usually pick this up on their database and automatically sort it out for me. How exactly do you claim that the photo has copyright? Are you a member of an union? Agency? Or do you automatically claim it to be copyright because it's yours? If it has been registered by someone other than yourself and have paid a fee for this, then it's their duty to sort it out for you. FalconFN Posted February 11, 2012 Report Share Posted February 11, 2012 You don't have to claim or register copyright as you own the photo as soon as you take it. if It's used without consent then it is in breach of copyright laws, no ifs, no buts, but unless they are making money from it the only action you can reasonably take is to come to an arrangement or ask them to remove it. Stunning picture which I posted on a fishing website. A very prominent barbel angler now uses that picture as his own both on the internet and in slide show presentations he does throughout the country. I have even seen him accept credit for the picture on line without mentioning the fact somebody else took the original picture and published it.
