Van accident,

Hi all,

This is a funny one,I have been working on a school extension,

And the site has a dedicated parking area.around this car park are the site cabins,but because the site is on a steep hill they have the one of the cabins built up on sleepers to level it up,

You have to drive around one side of this cabin to access the car park.

The sleepers that level this cabin jutt out into the car park by about

30cm and are approx 60cm high.the parking is very constricted ,any way on Tuesday I caught the sleepers as I was leaving the car park,now there are no warning tapes or warnings,around these hazards,

So my question is it worth trying to make a claim against the main contractor or just put it down to my driving.

Any advice appreciated

You caused the damage, you should regard yourself as lucky thet the sleepers didn't slip and cause damage to the cabin for which you would have been liable.

As this is the only parking we are allowed to use ,

I would have thought the main contractor would have to at least take reasonable precautions to to make any hazards visible,

And any driver would have to take reasonable precautions not to drive in to large inanimate objects!

As I said the parking is a nightmare,and as your trying to avoid other parked vans ,and fencing the sleepers are so low you can't see them from a vans cab,i just thought some kind of warning should have been put up.

 

Obviously I'm wrong.

We all have accidents, but some of us accept it is our fault, fix the damage and get on with it.

 

A forum is not really the place to look for sympathy!

Not looking for sympathy ,I was asking a valid question and only seeking advice,

but seeing as you seem to know everything.

Well funny you should say that -I wrote my Mrs's Xtrail of two weeks ago, totes my fault, hit a tree stump hidden in long grass while flying down a byway. At least I have speed as an excuse 😂 what was your excuse again?.......

You'll be paying it back over the next few years if you claim IMO because your insurance will need to be notified about how you drive without due care and attention.

 

Best just accept it was you who boobed by not noticing the obstructions prior to maneuvering in the restricted location.

She gave me THE look 😂 wasn't really speeding, byways are 60mph, was only doing about 40.

We have all done such things. It hurts a bit less when you can at least share the blame but in this case i would just take it on the chin, repair and crack on.

 

If feeling charitable id put some marker on the sleepers for the next chap, it sounds like you wont have been the first or the last to hit them.

I'd say your pride is probably hurt as much as the car and you want to lay some of the blame onto someone else......did you not see the sleepers or just misjudge the gap and hit them?

I'd be equally annoyed though, what a pain in the ****. Might be worth a letter to the main contractor to encourage them to do something about the lack of marking before it happens again!
